Timeframe for receiving your decision

The 30 day statutory period for processing your request commenced from the
day after the Department received your request, you should therefore
expect a decision from us by 29 November 2023.  The processing period of
30 days may be extended in certain circumstances and we will write to you
separately regarding any extension of time.

 

Charges

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the Department decides that you
are liable to pay a charge, we will send you a preliminary assessment of
the charge as soon as possible.

 

Publication of documents

Please note that information released under the FOI Act may later be
published online on our disclosure log at

subject to certain exceptions. If you think you might wish to raise any
objections to the publication of any of the information which may be

Exclusion of officers’ names and contact details

For documents that fall within scope of the request, it is the
Department’s policy to withhold:

·       any person’s signature;

·       the names and contact details of Australian Public Service
officers not in the Senior Executive Service (SES);

·       the mobile or direct numbers of SES officers;

·       the names and contact details of Ministerial staff at a level
below Chief of Staff.

 

If you consider that the information categorised above is relevant to the
terms of your request please let us know at [3][DPMC request email], otherwise
we will take it that you agree to that information being excluded from the
scope of your request (that is, the information will be treated as
irrelevant and deleted from any documents for release). The names and
other details of SES officers will not be withheld unless there is some

Confirmation of scope

 

Noting that your request include documents which are publicly available
via the [1]Right to Know website, we seek your confirmation that you are
amenable to exclude documents which are already publicly available, as
well as duplicates, from the scope of your request.

 

To assist the Department to continue processing your request, it would be
appreciated if you could provide this confirmation by COB Wednesday, 22
November 2023.

 

Notification of Third Party Consult

 

We also wish to advise that the request covers documents which contain
personal information of one or more individuals, and the Department is
required to consult with those individuals (under section 27A of the FOI
Act) before making a decision on the release of the document.

 

The consultation mechanisms under section 27A applies when we believe the
person or organisation concerned may wish to contend that the requested
documents are exempt for reasons of personal privacy. Where a consultation
under section 27A is entered into, the FOI Act provides an extension of
the processing period by 30 days (section 15(6)) in order to allow the
Department time to consult with that organisation or person. As a result
the extended due date of your FOI request is 29 December 2023, we will
endeavour to finalised the request at an earlier date if possible.

The current due date for a decision on your request is 29 December 2023.
The purpose of this email is to seek an extension in order to keep your
FOI request within time. The FOI Act has built-in provisions and
operations that provide for extensions to enable agencies to manage their
FOI requests and keep them within time. The Department would like to work
with applicants in managing the timeframes of its requests wherever
possible.

Your request currently falls due during the Department’s shutdown period,
and work continues to process documents relevant to the scope of your
request. Regrettably, the Department will not be in a position to finalise
your decision by the current due date, and seeks your agreement to an
extension of 21 days to the relevant timeframe. Your request will then be
due by 19 January 2024.

We will keep you updated on the progress of this request if circumstances
change, and endeavour to provide a decision prior to the extended due date
where possible.

If you agree to this request for an extension of time, I ask that you
confirm this in writing via return email by close of business
