I refer to your request for documents made under the Freedom of
Information Act 1982 (FOI Act). Specifically, you asked for:

 

1.      Current social media policy of the department, which covers
departmental use and/or private use by employees in an individual
capacity.

2.      Any current guidance material which is available for employees to
make informed decisions about their private social media use.

 

We received your request on 18 April 2016 and the 30-day statutory period
for processing your request started from the day after that date. You
should therefore expect a decision from us by 18 May 2016. The 30-day
period may be extended by a further 30 days if we need to consult third
parties or for other reasons.

 

The FOI Act and the Freedom of Information (Charges) Regulations 1982
allow agencies to charge for access to documents that do not contain the
personal information of the person making the FOI request. We will write
to you if we decide that you are liable to pay a charge to access the
documents you requested.

 

The information released in response to your request may later be
published online on our disclosure log, subject to certain exceptions. For
example, personal information will not be published when this would be

Locutus Sum left an annotation ()

The estimate of charges looks like some nonsense. What social media policy contains absolutely exempt matter? None. If it did contain exempt matter then it should not have been in the policy.

Also, the idea to charge a person for a copy of the social policy make the Fair Work Ombudsman to look very silly. It is the sort of behavior a person must expect from a child who does not like to share her sweeties.

I make a suggestion to the applicant to ask for a waiver of the fees on the basis of the public interest. He can support the public interest claim by reference with the media attention that the case of the worker who was dismissed from his job and then reinstated.

I refer to the freedom of information request you filed with our office on
18 April 2016, and your subsequent email of 10 May 2016, requesting waiver
of the charge on public interest grounds.

 

The Delegate has decide to release the documents you requested under the
Fair Work Ombudsman’s [1]Information Access Policy (that is, outside of
the Freedom of Information Act 1982). The documents you requested are
attached to this email, with the exception of two videos which are too
large to send electronically. If you provide a postal address I will post
then to you on a USB.

 

Information that is irrelevant to your request (that is, information that
does not relate to the FWO’s social medial policy or provide guidance to
employees about their private social media use) has been redacted from the
attached documents, as has personal information relating to our staff.

 

Can you please advise whether this satisfies your freedom of information
request? If it does, we will consider that you have withdrawn your request
and close our file.
