I would like to request under the FOI Act for a copy of the latest statement of claims used in bargaining meetings for the NIAA enterprise agreement, and a copy of the meeting minutes and agendas for the meetings held in October and November.

Thank you for your request to the National Indigenous Australians Agency
(NIAA) for access to documents under the Freedom of Information Act 1982
(FOI Act).

 

The NIAA received your request on 23 November 2023 and the 30 day
statutory period for processing your request commenced from the day after
that date.

 

You should therefore expect a decision from us by 23 December 2023. As the
due date for your decision fell on a weekend, section 36(2) of the Acts
Interpretation Act 1901 (Cth) allows the decision to be sent the next
business day, being 27 December 2023.

 

Christmas and New Year shutdown period

 

We note that the NIAA Christmas and New Year shutdown period runs from 23
December 2023 to 1 January 2024.

 

To ensure the NIAA may continue to process your request for documents
within the statutory timeframe, we are requesting an extension of time of
20 calendar days under section 15AA of the FOI Act, with your agreement.

 

If you agree to extending the timeframe for processing your request by 20
calendar days, a decision will be due to you by Friday 12 January 2024.
Please let us know if you agree by reply email to [1][email address], by 4
December 2023.

 

We will advise you if there are any further extensions of time, including
for third party consultation.

 

Charges

 

Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the decision-maker decides that
you are liable to pay a charge, a preliminary assessment of the charge
will be provided to you as soon as possible.

 

Publication

 

Please note that information released under the FOI Act may later be

Information out of scope

 

The NIAA treats the names and contact details of Commonwealth staff not in
the Senior Executive Service (SES), such as Australian Public Service
(APS) officers, and other personal details of all Commonwealth staff (such
as signatures and direct phone numbers) as not relevant to the scope of a
request.

 

Information that is irrelevant to your request will be excluded from any
documents which may be released to you.

 

Please note, the NIAA routinely excludes the following from documents
released in response to FOI requests:

•         duplicate documents

•         duplicate email chains

•         publicly available documents, and

•         draft or interim documents where a later version is included.

Thank you for the acknowledgement.

I accept the Christmas New Year period is difficult and agree to the proposed extensions.

I’m sure you gleaned this but I wish to clarify that my request is confined to the bargaining meetings held in October and November in 2023.

I would also be willing to withdraw my request entirely if the agency published these documents on the internal NIAA intranet for internal staff viewing only.
