Dear Mr Gerlach

I refer to your following request for access to documents made under the Freedom of Information Act 1982 (Cth)

* All records sent to scientific staff that it is important to ensure pH meters are calibrated on a regular basis

Your FOI request was received on 18 May 2023 but for some reason went to the junk folder. I apologise for the delay in acknowledging your request.

I am writing to tell you that the FOI decision maker intends to refuse your request on the basis that a practical refusal reason exists. However, before the decision maker makes a final decision in this regard, you have an opportunity to revise your request to remove the practical refusal reason. This is called a 'request consultation process'. You have 14 days to respond to the attached notice.

Kind regards

Gemma Larkins

Dear Freedom of Information Requests,

Thank you for your reply, stating that ANSTO considers that a “practicable refusal reason” exists in relation to my request under the FOI Act.

Please reduce the scope of my request to the time period of years 2008 until 2012. Further reduce the scope to any instruction given by line managers to scientists working under them relating to my request.

Yours sincerely,

Jake Gerlach

Freedom of Information Requests, Australian Nuclear Science and Technology Organisation

Dear Mr Gerlach

I refer to the revised scope of your FOI request in your email below dated 22 June 2023 and the extension provided by the Office of the Australian Information Commissioner until 24 July 2023 to process your request.

The scope has changed from an unlimited period to a 4-year period between 2008- 2012. The request for this time period is for any instruction given by line managers to scientists working under them relating to the importance to ensure pH meters are calibrated on a regular basis.

The scope of the request is still too broad and would result in a practical refusal because it would be necessary to first identify which scientists had supervisory duties for the 4 year period and then review emails record management systems/ archives/back up tapes and other correspondence for any 'instruction' given on the importance of calibrating pH meters.

To avoid a practical refusal, please confirm by Monday 17 July 2023 whether you agree to the following scope reduction:

'For the period from 1 January 2008 to 31 December 2012, any Controlled Business Management System documents regarding the importance of calibrating pH meters in the nuclear science division. . Excluding correspondence such as emails, letters, file notes and experiment specific records relating to the calibration of pH meters.'

Kind regards

Gemma Larkins
