Administrative Review Tribunal (ART) - Aggregated Statistical Data for NDIS Review Cases from 2019 to 2025

This request has been withdrawn by the person who made it. There may be an explanation in the correspondence below.

Dear Freedom of Information Officer,

This is a formal request for access to documents under section 15(1) of the Freedom of Information Act 1982 (Cth) ('FOI Act').

I seek access to documents containing aggregated statistical information regarding the performance of all General Members of the Administrative Review Tribunal ('ART') in National Disability Insurance Agency ('NDIA') review cases.

Scope and Timeframe

The required statistical data is to cover the period from 1 January 2019 to 31 August 2025.

I seek the production of a report, not the disclosure of existing discrete documents, as permitted under section 17 of the FOI Act. The approach should mirror the style of the report in decision document FOI Ref: 2025/1730 and specifically, include:

1. Total Annual Finalisations: A year-on-year breakdown of the total number of NDIA review cases finalised by all General Members.

2. Outcome Breakdown: Of the total finalisations for each year, a breakdown showing the number and percentage of outcomes that were:

* Favourable to the applicant (as defined in the precedent, including Consent - Remitted, Consent - Set Aside, Heard and Remitted, and Heard and Set Aside).

* Unfavourable to the applicant (as defined in the precedent, including Application Withdrawn, Consent - Dismissed, Heard and Affirmed, Dismissed, and No Jurisdiction).

*. Consent - Varied, shown as a separate statistic where both parties reached a mutual consent.

*. Processing Time: The average number of days for a final decision to be made in an NDIA review case across all General Members, presented on a year-by-year basis (calculated from the date the case was received by the Tribunal to the date of the final outcome).

Waiver of Charges

As this request pertains to aggregated official statistics and not to my personal affairs, I request a waiver of any applicable processing charges pursuant to section 29(5)(b) of the FOI Act. The release of this data promotes transparency and is clearly in the public interest by allowing for public scrutiny of the overall performance and accountability of the Tribunal's General Members in handling NDIA reviews.

I confirm that I am prepared to consult with your office to refine the scope if the processing of this request would cause a substantial and unreasonable diversion of resources.

Please confirm receipt of this request. I look forward to receiving the decision within the statutory timeframe.

Yours sincerely,
Mae

Dear Mae,

Please find attached an acknowledgement letter of your FOI request.

My name is Claire, and I have been allocated your FOI request along with a
similar request received on the same day. Given the significant
similarities, I believe this other request may have also been submitted by
you.

The other request is substantially the same as this one, a close
duplicate. However, the other request provides additional details about
the format of the chart requested.

Assuming this other request was submitted by you: would you consider
withdrawing this current request (FOI 2025/2316) to prevent duplication? I
would continue to process the other request, without delay.

Please let me know your intention, in writing, as soon as possible. If you
have any questions or concerns, please don’t hesitate to reach out to me.

Sincerely,

Claire B
