Dear Federal Circuit Court of Australia,

Background to this FOI:

The Marriage ACT 1961, up to 2017 (the Specified Period) read in part: "marriage means the union of a man and a woman to the exclusion of all others, voluntarily entered into for life".

As the Federal Circuit Court of Australia (‘the Court’) asserts that it has jurisdiction for a marriage, after an exhaustive search of public records and the Court web site there are no records/documents that show the Court providing any process, or access or Court contacts for a man/woman to:

a. make claim, and
b. prosecute a claim, and
c. give notice, and
d. other lawful actions as it relates to a marriage or property from said marriage.

hereinafter, collectively: 'Lawful Actions'

The Court only provides processes/access for legal entities such a ‘natural PERSON’ and denies the right and justice of man/woman, even though a marriage is clearly defined over the Specified Period as being a union between a man and a woman. The Court is required to provide the access for a man and a woman under the common law, the law of the land.

In addition, the Magna Carta (1297) 25 Edw 1 c 29 in force across the Commonwealth [Realm], reads in part that:

"No Freeman shall be taken or imprisoned, or be disseised of his freehold, liberties, or free customs, or be outlawed or exiled or in any other wise destroyed; nor will we not pass upon him nor condemn him, but by lawful judgment of his peers, or by the law of the land. We will sell to no man, and we will not deny or defer to any man either justice or right."

Additional Information:

The Attorney General’s Department response number FOI24/213 (hereinafter 'AGs Response') to a FOI request dated April 20, 2024 (link: https://www.righttoknow.org.au/request/r... ) states that Government entities do not have jurisdiction over a man [or woman] and do not have jurisdiction over a man’s [or woman’s] property.

Investigation of the Court

After investigation of the Court public documents, it is noted that:

a. the Court cannot charge [monetary] a man or a woman to access the Court, yet there are no public Court documents that describe this, except for the above mentioned Magna Carta (1297)
b. the Court denies lawful access for a man and a woman in order to generate revenue under the Court rules, in opposition to the Magna Carta and AGs Response.
c. the Court is unlawful in claiming a legal jurisdiction over a marriage whilst at the same time denying right and justice to a man and a woman in opposition to the Magna Carta (1297), and, the AGs Response to the referenced FOI, and, the Marriage ACT (1961) Specified Period.

What this FOI is not about:

This FOI does not seek any private information about: a man, a woman, a PERSON, a Staff member, or a case.

FOI Documents Sought from the Court:

a. documents that show the process/access and staff title(s) that support and assist a man and a woman with Lawful Actions, under the common law: the law of the land and justice at the Court, and
b. documents that show the Court has the jurisdiction to deny a man and a woman justice and right,
c. documents that show the type and frequency of training provided to the Court Staff and Judicial Staff to ensure: We will sell to no man [or woman], and we will not deny or defer to any man [or woman] either justice or right.
