Dear Department of Foreign Affairs and Trade,
I would like to request under the FOI Act the following information:
Agendas or briefing documents relating to the Five Eyes meeting in Queenstown, New Zealand in April 2017.
Dear Mr McDonald,
Please note that under section 7(2A) of the FOI Act, the documents which you request are exempt from the operation of the FOI Act.
Section 7(2A) An agency is exempt from the operation of this Act in relation to the following documents:
(a) a document (an intelligence agency document) that has originated with, or has been received from, any of the following:
(i) the Australian Secret Intelligence Service;
(ii) the Australian Security Intelligence Organisation;
(iii) the Inspector‑General of Intelligence and Security;
(iv) the Office of National Assessments;
(v) the Australian Geospatial‑Intelligence Organisation;
(vi) the Defence Intelligence Organisation;
(vii) the Australian Signals Directorate
(b) a document that contains a summary of, or an extract or information from, an intelligence agency document, to the extent that it contains such a summary, extract or information.
DFAT FOI Team.
This is insanely overdue. What's happening with this request? Should I file a complaint with the information commissioner or are you going to comply with the law?
Dear Mr McDonald
As advised to you previously, you are not able to seek access to documents of named intelligence agencies pursuant to s7(2A) of the Freedom of Information Act 1982.
Your FOI request is therefore not overdue because you are, by law, unable to request the documents to which you are seeking to access.
DFAT FOI Team
