Phillip Sweeney made this Freedom of Information request to Australian Prudential Regulation Authority

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

We're waiting for Phillip Sweeney to read recent responses and update the status.

Dear Australian Prudential Regulation Authority,

The Superannuation Safety Amendment Act 2004 amended the Superannuation Industry (Supervision) Act 1993 so that trustees of regulated superannuation trusts, funds or schemes were required to obtain a RSE Licence from APRA.

APRA granted RSE Licence L0000758 to Corporate Combined Superannuation Pty Ltd or CCSL Ltd in 2006 (or 2005).

The documents I seek are copies of the application form and other documents lodged by Corporate Combined Superannuation Pty Ltd (or CCSL Ltd) to obtain Licence L0000758 from APRA.

Yours faithfully,

Phillip Sweeney

Extension of time application by the Australian Prudential Regulation
Authority

Dear Mr Sweeney

I write to advise that on 17 September 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Australian Prudential Regulation Authority (the Agency) for an extension
of time, to process your FOI request.

The Agency has applied for an extension of time under s 15AC of the
Freedom of Information Act 1982 (Cth) because it has been unable to
finalise your request within the initial decision period.

The Agency has advised the OAIC that:

·         On 17 June 2021, the Agency received your FOI request.

·         On 14 July 2021, the Agency obtained your agreement for an
extension of time under s 15AA of the FOI Act for 30 days till 16 August
2021 (OAIC ref: RQ21/01789).

·         On 11 August 2021, the Agency obtained your agreement for an
additional extension of time under s 15AA of the FOI Act for 30 days till
15 September 2021(OAIC ref: RQ21/02198)

·         On 8 September 2021, the Agency requested an additional
extension of time from you, however it appears no response has been
received.

·         The Agency considers your request to be voluminous as it
consists of a large number of hard copy documents.

·         Due to the COVID lockdowns in both the Sydney and Melbourne
offices, the Agency has faced logistical issues in accessing these
documents due to current remote working arrangements.

·         The Agency requires additional time to review the hardcopy
documents and finalise the decision.

The Agency has requested an extension to 14 November 2021. I will take any
comments you may have to make into account when deciding the application.

Please respond to this email by close of business 28 September 2021. If I
do not hear from you by this date, the decision maker will make a decision
on the basis of the information provided to me by the Agency.

You will be notified of the decision once the matter has been finalised.

Further information about extension of time requests may be found on our
website at [2]Extensions of time.

Dear Jasmin Clarke,
Thank you for you prompt reply

There has been a lengthy delay in responding to what is a simple request.

I will not object to one more extension of time, but if there is a further delay, then I would appreciate the assistance of the Office of the Australian Information Commissioner

Yours sincerely,

Phillip Sweeney

Dear Jasmin Clarke,

Did you receive my previous email?

I agreed to the additional extension but will seek the assistance of the OAIC if there are future delays

Dear Australian Prudential Regulation Authority,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Australian Prudential Regulation Authority's handling of my FOI request 'Application for a RSE Licence'.

APRA has released documents related to the application for registration of a superannuation fund administered by this particular corporate trustee so there should be no reason not to release documents associated with the application for a RSE Licence by the same trustee.

Any personal information can be redacted

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/a...
