Dear Ms Ryan

Acknowledgement of Freedom of Information Request No: LEX 22229

I refer to your request received by the Department of Agriculture, Water
and the Environment (department) on 14 March 2021 for access to documents
under the Freedom of Information Act 1982 (FOI) made in the following
terms:

May you please provide copies of the applications made to protect Mount
Panorama/Wahluu under sections 9 and 10 of the Aboriginal and Torres
Strait Islander Heritage Protection Act.

Your address

The FOI Act requires that you provide us with an address which we can send
notices to. You have advised your electronic address is
[1][FOI #7146 email]. We will send all notices
and correspondence to this address.

Please advise us as soon as possible if you wish correspondence to be sent
to another address or if your address changes. If you do not advise us of
changes to your address, correspondence and notices will continue to be
sent to the address specified above.

Disclosure log

Please note that information released under FOI Act may be published in a
disclosure log on the department's website. Section 11C of the FOI Act
requires this publication, however it is subject to certain exceptions,
including where publication of personal, business, professional or
commercial information would be unreasonable.

Exclusion of junior department employee details

The department is working towards ensuring that all employees have a
choice about whether they provide their full name and direct contact
details in response to public enquiries. Where such details are included
in the scope of a request, this may add to processing time and applicable
charges as it may be necessary to consider whether the details are exempt
under the FOI Act. On this basis, unless you tell us otherwise, we will
assume that these details are out of scope of your request and they will
be redacted under section 22 of the FOI Act.

Further assistance

If you have any questions please email [2][email address].

Dear Foi,
Thank you for your response.
I would only seek correspondence to and from the Wiradyuri Traditional Owners Central West Aboriginal Corporation, Bathurst Regional Council and Bathurst Kart Club.

I would seek any reports carried out, excluding the one by Extent Heritage.

I do not require culturally sensitive information.
Yours sincerely,

Eleanor Ryan

Dear Ms Ryan,

Thank you for your email of 6 April 2021 with your revised scope. We note
in your revised scope you are seeking:

o correspondence to and from the Wiradyuri Traditional Owners Central
West Aboriginal Corporation, Bathurst Regional Council and Bathurst
Kart Club;
o any reports carried out, excluding the one by Extent Heritage; and
o Not any culturally sensitive information.

The department has completed preliminary searches of the above revised
request and consider that your request is likely to still be too big to
process as the department has estimated over 850 pages of information
within the scope of your request, which includes material relating to
third parties which the department is required to consult with.

As the consultation period for your request has not yet ended, it is open
to you to consider revising your request further. If you wish to revise
your request, you may consider:

o excluding university academic material;
o excluding personal and business information relating to third parties;
o reducing the type of documents you are seeking; and
o asking for specific documents rather than seeking "any documents" or
"all documents" and
o seeking documents withing a short and specific timeframe.

If you wish to revise your request, please let us know by COB Monday 12
April 2021. If we do not hear from you by then, we will continue
processing your revised request:

o correspondence to and from the Wiradyuri Traditional Owners Central
West Aboriginal Corporation, Bathurst Regional Council and Bathurst
Kart Club;
o any reports carried out, excluding the one by Extent Heritage; and
o Not any culturally sensitive information.

Kind Regards

Dear Foi,
Please further amend my request to exclude personal and business information of third parties.
Yours sincerely,

Eleanor Ryan

Dear Ms Ryan,

Thank you for your email of 9 April 2021 and for revising your request. We
appreciate your continued engagement with us as we seek to revise the
scope to a processable size. Unfortunately your latest revision has not
significantly reduced the number of documents and pages within the scope
of your request.

We ask that you consider revisions that may reduce the number of documents
that fall within the scope of your request as well as the documents’
content. On 6 April 2021 we provided the following suggests which you may
wish to consider:

o excluding university academic material;
o reducing the type of documents you are seeking;
o specifying the party for which the documents you are seeking
originated from;

o asking for specific documents rather than seeking "any documents" or
"all documents"; and
o seeking documents withing a short and specific timeframe.

If you wish to further revise your request you can do this by COB Tuesday
13 April 2021 as your consultation period ends on this date.

If we do not hear from you by this date, we will continue processing your
request based on your latest revised request of:

‘Copies of the applications made to protect Mount Panorama/Wahluu under
sections 9 and 10 of the Aboriginal and Torres Strait Islander Heritage
Protection Act, specifically:

o correspondence to and from the Wiradyuri Traditional Owners Central,
West Aboriginal Corporation, Bathurst Regional Council and Bathurst
Kart Club;
o any reports carried out, excluding the one by Extent Heritage; and
o Not including;

o any culturally sensitive information; and/or
o personal and business information of third parties.’

Kind Regards
