Good morning

I refer to your email below in which you have requested information regarding Au pairs entering Australia.

The Department does not currently regard your request as valid for the purposes of the FOI Act.

Section 15(2)(b) of the Act provides that you must provide such information concerning the document you are seeking access to as is reasonably necessary to enable a responsible officer of the Department to identify it.

Section 12 of the FOI Act provides that a person is not entitled to obtain access to documents that are available for purchase by the public in accordance with arrangements made by the Department.

The Department publishes a large number of policy documents (PAMS) on LEGEND.com. These documents can be accessed by a subscription to LEGEND. As such, any request for access to documents that are published on LEGEND is not a valid request for the purposes of section 12 of the FOI Act.

You have also asked for "the number of Au pairs entering Australia yearly". You have not, however, specified a timeframe for this request, and as such, I do not consider that you have provided sufficient information for the Department to be able to identify the documents you are seeking access to for the purposes of section 15(2)(b) of the FOI Act.

May I suggest that in the first instance you review the information contained in the PAMS that have been published on LEGEND. If you do not have access to a subscription for this service, most major libraries do provide access to the service. In the event that the information contained on LEGEND is not sufficient for your purposes, you may submit a request, providing full details of the types of documents you are seeking access to. Your request should provide sufficient detail for the Department to understand exactly the nature of the documents you are requesting.

In relation to your request for statistics, the Department does publish a number of statistical reports. You may wish to review these reports in the first instance: http://www.border.gov.au/about/reports-p....

In the event that you wish to submit a formal request for access to statistics, please limit your request to specified financial years.

If you have any queries, please do not hesitate to contact the FOI Section at [email address].

With kind regards
