Freedom of Information Request FOI22/331 - Scope consultation

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) received by the Attorney-General's Department for access to the
following documents:

I would like to seek any documents that pertain to the Attorney-General's
decision to overturn the prosecution of Bernard Collaery, if such
documents exist.

 

Scope consultation:

The department has conducted preliminary searches for your request and
considers that a practical refusal reason exists under s 24 of the FOI Act
in relation to your request in its current form due to the number of
documents found and processes involved. Therefore we ask that you consider
refining your scope to make it more specific about what documents you are
or are not seeking. Preliminary searches undertaken of the department
records have indicated that the terms of your request in current form is
so broad and in such general terms that searches of these terms produce a
large number of documents.

 

The department would like to give you the opportunity to consider the
terms of your request. For example, you may consider revising your request
by:

o specifying documents for a specific purpose (for example. briefings
and advice to the Attorney-General about the matter)
o excluding certain types of documents (for example. drafts and
duplicate documents/attachments/email chains)
o providing the department with further information on what documents
you are specifically interested in. As stated above, these general
terms produce a large number of results, which currently places a
burden on the department in processing the current scope of your
request.

 

Extension request:

The decision for your request is due on 4 January 2022. The
Attorney-General’s Department will be closed from 24 December 2022 until
Monday 2 January 2023 (inclusive). For this reason, we seek your agreement
to a short extension of time, of 21 days, under section 15AA of the FOI
Act. This will enable us to finalise your request, consistent with the
requirements of the FOI Act, when the department reopens after the
Christmas break. If you agree to this extension, the decision on your
request will be due on 25 January 2022. However, we will endeavour to
provide it to you as soon as possible.

 

Please note that if you agree to the extension, the department is required
to notify the Office of the Australian Information Commissioner, including
your name and contact details.

I am specifically seeking documents such as briefings or advice that were prepared for the Attorney-General, any statements written or prepared by the Attorney-General, any correspondence that the Attorney-General's office had undertaken with Mr. Collaery, and any correspondence that the Attorney-General's office had with the Director of Public Prosecutions regarding this case.

I am not seeking drafts or duplicates of the above documents.

enable us to finalise your request consistent with the requirements of the
