Dear Australian Bureau of Statistics,

I respectfully request the following information under Freedom of Information Act 1982:

1. Documentation in which the reasons for retaining name and addresses in the Census are justified to ABS management, and a copy of that decision.

2. Any documentation in which requests for this retention of personal data in Census are made, whether that request originated from within ABS, or externally.

3. A copy of any relevant policies pertaining to ABS staff who have the ability to access Census data. In particular, I am looking for documentation which assists ABS staff to ensure they are using ABS data only for the purpose for which it was collected.

4. A report which describes misconduct of ABS staff generally, including inappropriate access and/or misuse of data held by ABS. Please provide the most recent report which covers a one-year period, if that is how your reporting works.

Dear Mr Smith,

I refer to your application of 11 April 2016 in which you seek access to
documents under the Freedom of Information Act 1982. You have requested
the following documents:

Clarification of Scope

Regarding point 3 of your request, can you please clarify whether your
reference to 'ABS data' is to be interpreted as 'ABS Census data' (ie.
statistical information) as opposed to other data that the ABS holds
(staffing/personnel information etc.)?

Regarding point 4 of your request, where the ABS compiles summary reports
to management on instances of staff breaching of the Australian Public
Service's Code of Conduct (the APS Code of Conduct is in section 13 of the
Public Service Act 1999), would such reports adequately satisfy your
information requirements under this request?

Notification of Receipt

Your request was received by the ABS on 11 April 2016 and, subject to your
clarification of the scope, the 30 days statutory period for processing
your request commenced from that date. If this request will take longer
than 30 days to process, we will contact you to negotiate an extension of
time.

You will be notified of any charges in accordance with the Freedom of
Information (Fees and Charges) Regulations, should they apply, in relation
to your request as soon as practicable.

Thank you for your quick response.

With regard to point 3, I clarify 'ABS data' to mean data that is collected by the ABS through the census, in addition to data which is held by ABS in order to facilitate the census (this may include, for example, any datasets which include the names and addresses, or any personal information, of all Australians).

With regards to point 4, I confirm a summary report will adequately satisfy my requirements.

Dear Mr Smith,

The relevant business areas in ABS have been assisting the Freedom of
Information (FOI) team in processing your FOI request.  Your request was
received on 11 April 2016, and you confirmed scope clarifications on 15
April 2016.

The ABS has completed and exhaustive search for documents pertaining to
your request. Due to an unexpectedly large number of documents provided to
the FOI team for decision, I am requesting an extension of 14 days  in
accordance with section 15AA of the Freedom of Information Act 1982 (FOI
Act) to the required processing period in order to respond to your
request.  We will endeavour to finalise your request as quickly as
possible within this timeframe.
Under section 15AA of the FOI Act, an extension can only be granted if
you, the applicant, agree in writing to this proposal. If you agree to
this request, the ABS will be required to respond to your request no later
than 30 May 2016.

Can you please consider this request and provide a response stating
whether you agree or decline to accept this proposal for an extension?
