Dear Australian Public Service Commission,

The document or documents I seek would list what Commonwealth Agencies currently fall under the remit of the Australian Public Service Commission and the Public Service Act 1999 (Cth).

I am specifically interested in a document that would confirm whether APRA and/or ASIC are on the list of Commonwealth Agencies that are under the remit of the Australian Public Service Commission and the Public Service Act 1999 (Cth).

I am responding to your recent FOI request.

 

The following web page, which is updated from time to time, lists all
bodies that are an ‘agency’ under the Public Service Act 1999 (PS Act):

The Australian Prudential Regulation Authority (APRA) and the Australian
Securities and Investments Commission (ASIC) are not included in that list
and so are not subject to the PS Act.

 

Further information about all non-corporate and corporate Commonwealth
entities, including APRA and ASIC, is available in the 'PGPA flipchart'
published by the Department of Finance:

As the information provided above appears to meet your needs, we will

I note that the listing is as of July 2019.

I note that APRA and ASIC are not on this listing as you confirm.

Can you please confirm if ASIC was subject to the PS Act prior to 1 July 2019 by say proving a listing of agencies from historic documents.

Dear Sweeney,

 

Prior to 1 July 2019, the Australian Securities and Investments Commission
(ASIC) was under the then [1]section 120 of the Australian Securities and
Investments Commission Act 2001 (ASIC Act) subject to the Public Service
Act 1999 (PS Act).

 

On 1 July 2019, section 120 of the ASIC Act was [2]repealed and replaced
with a section that effectively removed ASIC from the PS Act’s
jurisdiction. The current ASIC Act as in force can be found [3]here.

 

We trust this meets your needs, unless you otherwise indicate by 12 August
2020, we will now treat your request as withdrawn.
