participant - PWC Australia between 5 Jan 2024 and today in regards to any
           outstanding 2023/24 reporting obligations.

Your Freedom of Information request – Third Party Consultation - LEX 81836

We refer to your request received by the Department of Climate Change,
Energy, the Environment and Water (department) on 9 December 2025 for
access to documents under the Freedom of Information Act 1982 (FOI Act)
made in the following terms:

‘Please provide a copy of all written or email communications with the
department and the former Climate Active certified participant - PWC

Third party consultation – documents affecting business information

Your request covers documents which contain business, commercial or
financial affairs of an organisation, or a person’s business or
professional affairs.

The department is required to consult with those individuals and entities
under section 27 (Business documents/information).

The consultation mechanism under these sections applies when the
department considers the department/Minister’s Office considers the person
or organisation concerned may wish to contend that the requested documents
contain business or financial affairs.

The department will take into account any comments received from the
relevant individuals/entities.  However, the final decision about whether
to grant you access to the documents you requested rests with the FOI
delegate in the department. 

Time limits for processing your request

Under section 15(6) of the FOI Act, the period for processing your request
has been extended by 30 days to allow the department time to consult with
the relevant third parties. Accordingly, you can now expect a decision on
Monday 9 February 2025.
