By what authority did the agency deem the request to have been withdrawn? Maybe I do not know the Act well but I cannot see any power for the agency to do such thing. Section 16 of the Act allows an agency to transfer a request to another agency if the subject matter of the request is more relevant to the other agency and the other agency agrees but this does not apply here. The action of the agency appears to be an access refusal decision under the Act but the agency did not like to say this!
