I request copies of all files notes and records regarding the operation and processing of all camera related fines by mobile speed camera, fixed and red light camera fines in NSW.
Including but not limited to the electronic transfer from sites around nsw to the office of state revenue and the processing of fines, developing and use of algorithms to allow photographs to be altered and varied prior to transfer over to RMS before being used for evidence in court

I have forwarded this request to Revenue NSW who has advised the following:

Speed, red light and bus lane cameras are used throughout NSW and operated by the Roads and Maritime Services. More information on camera operations can be found at www.rms.nsw.gov.au/roads/safety-rules/sp... or by contacting Roads and Maritime Services.

Revenue NSW issues penalties directly for camera-detected offences, such as speeding, driving through a red light, and driving in a bus lane. Revenue NSW adheres to internal procedures for the processing of all camera related fines. The disclosure of this information would prejudice the effective exercise of Revenue NSW's functions in accordance with Section 14 of the Government Information (Public Access) Act 2009 - public interest considerations against disclosure.

Revenue NSW would not consider an informal release - and even if the applicant submitted a formal GIPA application, Revenue NSW would have strong objections (as outlined above) to releasing the information as it is not publicly available information.

I am writing to request an internal review of NSW Office of State Revenue's handling of my FOI request 'copies of all documents manuals relating to the operation conversion transfer and processing of all camera related fines prior to issuing to the RMS'.

[ i am currently challenging a speed camera related fine in court in NSW and it is my express opinion that information regarding all camera related offences upon activation of a camera regarding c camera related fine in NSW the data is electronically transferred to the Office of State Revenue (Revenue NSW).
Upon completion of details of the offences by staff at Revenue NSW, notices regarding the offences are then posted to the owner/drivers of the related vehicles in relation to the alleged offences.
In doing so if because of t he time of the alleged offences, or quality of photographs taken the person/s who process the photographs to be used in court if a person challenges the offence use a process whereby the photographs are altered,

PHOTOS ARE PUT THROUGH A NUMBER OF COMPUTER MATRICES DESIGNED TO BOOST CONTRAST, ELIMINATE SHADOW AND HEIGHTEN RESOLUTION OF THE ORIGINAL IMAGE
HOW THEY WORK AND ARE MANIPULATED... IS THE COMPUTER USES AN ALGORITHYM OF THE PHYSIOLOGY OF THE ORIGINAL IMAGE AND MAKES CHOICES...

In doing so the photos are being intentiallly altered using this process then presented over to the RMS and given to defendant in matters before the court.

This process does not comply with section 138 (6) of the Road Transport Act 2013, which states that photos must bear a security code indicator of a kind prescribed by the regulations bearing a security code indicator to show that the photo has not been altered since it was taken.

The Office of Revenue NSW has been doing this process for many years which is incorrect and as per my reply to the above issue/complaint the reply received stated, "REVENUE NSW ADHERES TO INTERNAL PROCEDURES FOR THE PROCESSING OF ALL CAMERA RELATED FINES. THE DISCLOSURE OF THIS INFORMATION WOULD PREJUDICE THE EFFECTIVE EXCERCISE OF REVENUE NSW FUNCTIONS IN ACCORDANCE WITH SECTION 14 OF THE GOVERNMENT INFORMATION (PUBLIC ACCESS) ACT 2009 PUBLIC INTEREST CONSIDERATIONS AGAINST DISCLOSURE.
