Dear Mr Sweeney,

APRA is currently considering your FOI request.

To enable APRA to effectively process your request and provide you with a timely response, APRA recommends that you refine the scope of your request. This is because APRA’s initial view is that the scope of your FOI request is very broad.

Some ways in which you might refine the scope of your request include (but are not limited to):

a. providing more details about what correspondence between Wayne Byres and/or APRA and Joseph Longo and/or ASIC you are interested in, if this is known to you;
b. narrowing the timeframe you originally suggested.

It would also be of assistance if you would please clarify whether you are seeking:

a. documents provided by Wayne Byres and/or APRA to Joseph Longo and documents provided by Joseph Longo and/or ASIC to Wayne Byres; or
a. documents provided by APRA to ASIC and by ASIC to APRA.

Action required:

Please provide a response by COB 4 August 2021 as to whether you are agreeable to refining the scope of your request and indicating how you intend to do so.

Kind regards,

FOI OFFICER

Dear Freedom of Information,

Joseph Longo has made a commitment before a Senate Committee for ASIC to collaborate with APRA.

The correspondence from Joseph Longo (or ASIC) to Wayne Byres, Hellen Rowell or APRA would relate to documents obtained or should have been obtained when APRA registered superannuation funds pursuant to the Superannuation Safety Amendment Act 2004 which came into effect in 2006.

The documents that APRA may have provided Joseph Longo would be copies of some of the documents lodged with APRA in order to obtain fund registration and correspondence from a trustee or trustees associated with the documents lodged for fund registration

The search period for correspondence from ASIC is from 1 June 2021 until the time APRA responds to this FOI request.

The search period for documents lodged with APRA in order to obtain fund registration is from 1 January 2006 to 30 June 2006. These would be the documents APRA may have provided to ASIC.

Yours sincerely,

Phillip Sweeney
