Pursuant to The Freedom of Information Act 1982 (Cth) I request all records relating to the cropping pond incident of 15 March 2002 in which a spent fuel element was cut incorrectly and dead opossums where found in the roof space of BLD 23 with dead birds found around this building.

I acknowledge receipt of your request under Freedom of Information Act
1982 (FOI Act) made on 19 February 2024 seeking the following:

All records relating to the cropping pond incident of 15 March 2002 in
which a spent fuel element was cut incorrectly and dead opossums were
found in the roof space of BLD 23 with dead birds found around this
building.

Processing period

Section 15 of the FOI Act requires ANSTO to process your request no later
than 30 days after the day the request is received. Your FOI request was
received by ANSTO on 19 February 2024. This means that the current
decision due date for your request is 20 March 2024.

 

The due date may be extended in certain situations. Section 15(6) of the
FOI Act allows us a further 30 days in situations where we need to consult
with third parties about certain information, such as business documents
or documents affecting their personal privacy. Further sections 15AA and
15AB of the FOI Act allow for extensions of time by consent or Order of
the Office of the Australian Information Commissioner. We will advise you
if the timeframe for your request is extended.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Australian Nuclear Science and Technology Organisation's handling of my FOI request 'Cropping pond incident leading to dead birds around BLD 23.'.

The subject of the redacted lines under exemption 33(a)(i), can only be expected contain similar contextual information to that immediately before and after. In this sense it is hard to see how this information could cause damage to the security of the Commonwealth.

I find it unlikely that other documents don’t exist, due to the points discussed in the 2 documents partially released.

No information has been provided about the dead opossums found in the roof of the building, or about the dead birds found around this building at the time of this incident and offsite.

Several pages are redacted under section 22, however given the length of time since this incident I find it unlikely that this information is to be published in the future. Given this it is likely that the public interest test would further promote release of the document.
