Dear SB Moreland,

 

I refer to your request for access to documents made to the Office of the
Australian Information Commissioner (OAIC) under the Freedom of
Information Act 1982 (Cth) (FOI Act).

 

Scope of your request

Your FOI request was made in the following terms, in two separate emails.
The OAIC will interpret the two emails to be two parts of the same
request:

 

 1. I would like to request a copy of all deliverables from the Nous Group
under the contract for "Strategic planning services" CN4012173
(including its amendment CN4012173-A1) . This request is made under
the Freedom of Information Act 1982.

 

 2. I would like to request a copy of the procurement documentation for
the Nous Group contract for "Organisational redesign and change
management support" CN4060386. Please include in scope:

 a. the RFQ or equivalent tender document,
 b. the Nous Group's response to the RFQ, and
 c. the contract or agreement between the Commonwealth and the Nous
Group.

 

 

Can you please confirm that you intend your request to be seeking:

 

Documents the OAIC holds in relation to contract CN4012173 between the
OAIC and NOUS Group. Including documents relating to deliverables,
procurement, tender, request for quotation and official contract.

 

Please confirm whether you agree with the scope of your request as we have
interpreted it by COB 26 June 2025.

 

In order to process your request as efficiently as possible, I will
exclude duplicates and early parts of email streams that are captured in
later email streams from the scope of this request, unless you advise
otherwise.

 

 

Publicly Available Documents

 

The OAIC believes that some, if not all, of the documents you are seeking
are already available on the OAIC disclosure log.

 

 1. [1]FOIREQ25/00170 has released documents in relation to:

o Any contracts or agreements between the OAIC and Nous Group Pty Ltd
(including related entities such as NousCubane) entered into or active
between 1 January 2022 and the date of the request; and
o Any invoices, purchase orders, or payment authorisations issued by the
OAIC to Nous Group during the same period.

 

 2. [2]FOIREQ24/00563 has released documents in relation to:

o Briefings and decisions concerning the procurement of Nous Group to
deliver structure and change management support, which encompasses:

o   Request for quote (RFQ) and Statement of Requirements

o   Procurement memorandum dated 2 May 2024

o   Procurement evaluation plan of 17 May 2024

o   Evaluation report of 27 May 2024

o Deliverables required to be provided by Nous as part of its contract
to deliver structure and change management support to the OAIC, being:

o   Change management plan (‘Transition plan’) (24 August 2024)

o   New organisational structure (‘Structure report’) (26 August 2024.

 

o As well as Ministerial briefing notes relating to the engagement of
NOUS, the transition plan and organisational structure

 

 

For your convenience I have attached the relevant documents that have been
released.

 

If the documents that I have attached are the documents you are seeking,
we kindly request that you withdraw your request. If the documents are not
what you are seeking, we kindly request clarification of your scope.

Timeframes for dealing with your request
Your FOI request was received by the Office of the Australian Information
Commissioner (OAIC) on 18 June 2025.

Section 15 of the FOI Act requires the OAIC to process your request no
later than 30 days after the day we receive it. However, section 15(6) of
the FOI Act allows us a further 30 days in situations where we need to
consult with third parties about certain information, such as business
documents or documents affecting their personal privacy. If we need to
consult a third party during the processing of your matter, we will let
you know.

 

 

As a decision on your FOI request is due on Friday 18 June 2025. We will
advise you if the timeframe for issuing you a decision is extended for any
reason.

 

Disclosure Log
Documents released under the FOI Act may be published online on our
disclosure log, unless they contain personal or business information that
would be unreasonable to publish.
