On 16 November 2023, you submitted a further application addressed to “ACT
Law Courts And Tribunal Administration” seeking the above information in
addition to the following information:
“all documents pertaining to the appointment of the following Members,
including but not limited to resumes, references, and recommendations:

o Geoffrey McCarthy
o Robert Orr

On 16 November 2023, the Chief Minister, Treasury and Economic Development
Directorate transferred an application to the JACS FOI team seeking the
above information.
I confirm that your application pertaining to Declarations of Interest
(ref 2023/22981) in accordance with section 40 of the FOI Act, a decision
on access is due to you by 3 January 2024.
I note the application pertaining to recruitment of ACAT members (ref
2023/23608) involves broader consultation and as such we seek your
agreement to an extension of 10 workings days (19 January 2024).

Per section 40 of the Act, "A respondent to an access application must decide the application not later than 30 working days after the day of receiving the application". The legislated due date for 2023/22981 is 3 January 2024, not 14 December 2023.

Canberra tax payers are not entitled to view documents which pertain to the hiring and selection of the people whose salaries we pay. ACAT is NOT an impartial and fair forum. These people are selected by the ACT Government to rubber stamp their legislation.
