I refer to your correspondence of 3 June 2021 to the Department of Health
(department) seeking access to FOI request document showing the number of
FOI requests over 30 days old that relate to COVID-19 between 1 February
2020 to today. Your request in its current format is not valid under the
FOI Act.

 

Section 15 of the FOI Act requires that a request for access meets certain
requirements. A Freedom of Information (FOI) request must:

 

• state that the request is an application for purposes of the FOI Act;

• provide sufficient information about the document(s) to allow us to
process the request; and

• provide an address for reply.

 

In order for your correspondence to be processed under the provisions of
the FOI Act, we require further information to enable us to identify the
document or documents you are seeking. Clarification is required on ‘over
30 days’, as this could mean decisions that have not been made within
statutory timeframes or requests being processed that are over 30 days
old.

 

Based on our interpretation, we have prepared an example of wording which
would make your request valid:
