Enterprise bargaining - what information is provided to department about employees' votes?

Dear Department of Employment,

This is request for information under the Freedom of Information Act.

I request all documents wherein the outcome of any enterprise bargaining ballots were communicated to the department by the entity who undertook the ballots.

This shall include the YES/NO vote amounts or percentages as well as any additional information related to the vote. For example, a breakdown of the vote by employee location, or APS level.

The scope of this request covers any such documents that were received as a result of EBA offers made to staff under:

Workplace Bargaining Policy 2015
or
Australian Government Public Sector Workplace Bargaining Policy 2014

Thank you for your correspondence below.

 

I note that you have now formally requested these documents under a
separate FOI request received by the Department on Sunday 26 February
2017.

 

Given this, and the processing time that has already elapsed, we have
decided not to consider this as an amendment of the scope of your initial
request. The Department will treat your request for the documents below as
a new request under the FOI Act, with a commencement date of 26 February
2017.

I am advised that the Department received only the total number of YES 
votes and the total number of NO votes. The Department did not receive a 
ratio of yes/no votes by classification.

I refer to your request of 26 February 2017 (below) for access to
documents under the Freedom of Information Act 1982 (Cth) (the FOI Act).
Please find attached the Department of Employment’s decision in relation
to your request.

 

I also refer to your previous request of 16 February 2017 relating to the
data provided to the external organisation responsible for conducting the
Department’s Enterprise Agreement ballots. The Department treated this as
an administrative request for information, rather than a request for
documents under the FOI Act. On 23 and 24 February 2017 the Department
provided you with information in response to that request and your related
further query. As we have not received any correspondence from you on this
matter since our last email of 28 February 2017, we consider this matter
to be finalised.
