I refer to your email dated 10 March 2015 in which you have sought access to documents held by the Australian Customs and Border Protection Service (ACBPS) under the Freedom of Information Act 1982 (FOI Act).

You have requested access to:

'a copy of the Contract between ACBPS and "RELEGEN" with the ID "CN2098791" and description "CMO039650 - Software Supp & Main" as listed on AusTender.'

Your application was received on 10 March 2015, and the 30 day statutory period for processing your request will commence from that date.

I refer to your request dated 10 March 2015 for access to documents held by the Australian Customs and Border Protection Service (ACBPS) under the Freedom of Information Act 1982 (the FOI Act).

ACBPS has identified one document that falls within the scope of your request. This document contains information that an organisation or undertaking might reasonably wish to make an exemption contention because of business information within the document. ACBPS must not decide to give access to the business affairs information unless the third party about whom that information relates has been given a reasonable opportunity to make submissions in support of the exemption contention.

ACBPS intends to consult third parties prior to making a decision on access to the document under section 27 of the FOI Act. As a result, the timeframe for processing this request has been extended by 30 days in accordance with subsection 15(6) of the FOI Act.

The consultation in this matter has now been finalised, and the decision maker is in the process of reviewing the document with a view to making a decision on its release to you.

A decision is currently due on or before 18 May 2015, and ACBPS anticipate being in a position to be able to issue a decision on release to you on or before that date.

Dear FOI Coordinator,

Thank you once again for letting me know about the status of this FOI request. I am very much looking forward to the Department's decision on or before 18 May 2015.

I do have one query. In my initial FOI request I provided a link to the Australian Governments Tenders Website that referenced this Contract of which ACBPS is now making a decision. I note that not long after I made this FOI request that link became broken and that further searching of the Tender website for this Contract with either "CMO039650" or "CN2098791" of which this FOI request was based on now returns no result.

As the Department has shown the existence of this Contract by acknowledging this FOI request and it's consultation with a third party I ask wether the Department is able to explain why this tender was deleted from the public domain?

I also wish to convey my thanks to the FOI section of the Department for their professional and courteous communication with me regarding this and other FOI requests. I look forward to continuing this dialogue upto, including and beyond 18 May 2015.

Good morning

Thank you for your email of 23 April 2015 below. I have obtained advice from the Procurement and Contracts Branch that purchase order CMO039650 related to support and maintenance of the Relegen products and it was established after the receipt of your FOI request that it had been incorrectly reported on Austender. The value of this PO was already included in the contract value of the original Austender Contract Notice and to avoid duplication it was deleted.

The correct Contract Notice number for the Relegen contract is CN332154-A4 - a copy of the details on AusTender relating to that contract is attached for your reference.
