Hi Amanda,

Just letting you know there is an error in the body text of your request. The incident number in the Subject line is the correct incident you wanted to request. What's happened is that there was a small error in The Global Mail's visualisation that led to the body text not appearing correctly.

The best way forward is to just email DIAC back again to clarify that the incident number you're seeking is the one in the subject line.

Just to follow-up on Paul's note, as you will see, the correct number is in the subject line of your request. So kindly update your request by clicking "Send a follow up" to DIAC clarifying that the incident you are interested in is in the subject line. (The bug is now fixed on Behind The Wire.)

Thank you for your FOI request below.

I am writing to advice that the department is unable to treat your request as valid due to the operation of Section 15 of the FOI Act.

Section 15 of the FOI Act states that FOI requests for access must provide such information concerning the document as is reasonably necessary to enable a responsible officer of the agency to identify it.

As the incident report you have requested in the subject of your email is different to the incident report you have requested in the body of the email, we are not able to determine which incident report you are actually seeking.

Grateful if you could please clarify what you are seeking, otherwise the department will not be progressing this request. For your information I have included the relevant section of the FOI Act below.

FREEDOM OF INFORMATION ACT 1982 - SECT 15 Requests for access Persons may request access

(1) Subject to section 15A, a person who wishes to obtain access to a document of an agency or an official document of a Minister may request access to the document.
Requirements for request
(2) The request must:
(a) be in writing; and
(aa) state that the request is an application for the purposes of this Act; and
(b) provide such information concerning the document as is reasonably necessary to enable a responsible officer of the agency, or the Minister, to identify it; and
(c) give details of how notices under this Act may be sent to the applicant (for example, by providing an electronic address to which notices may be sent by electronic communication).
