Dear Australian Prudential Regulation Authority,

In order to obtain fund registration Trustees had to lodge a copy of the founding Trust Deed with APRA pursuant Section 29L of the SIS Act.

The document I seek are a copy of the founding Trust Deed of the National Australia Bank Group Superannuation Fund A and a copy of the decision of APRA to grant fund registration.

The trustee at the time of fund registration was most likely to be National Australia Bank Superannuation Fund Ltd

Dear Mr Sweeney

I refer to your request for access to documents relating to the National Australia Bank Group Superannuation Fund A under the Freedom of Information Act 1982 (FOI Act).

As your request covers documents which contain information concerning the business, commercial or financial affairs of an organisation, or a person’s business or professional affairs APRA is required to consult with the person or organisation concerned (under section 27 of the FOI Act) before making a decision on the release of those documents.

For this reason the period for processing your request has been extended by 30 days in order to allow APRA time to consult with that person or organisation (section 15(6) of the FOI Act). The processing period for your request will now end on 13 October 2018.

I am writing to request an internal review of Australian Prudential Regulation Authority's handling of my FOI request 'Founding Trust Deed of the NAB Staff Super Fund'.

APRA granted fund registration number R1005103 for the National Australia Bank Fund A on 28 April 2006. If a copy of the founding Trust Deed had not been lodged with APRA, then a document must have been represented to a APRA as the "Trust Deed" of this fund as required by s29L of the SIS Act.

It is not always clear if a document that is represented as a "Trust Deed" is in fact the founding Trust Deed or a consolidation of the founding Trust Deed and previous amending Deeds.

Therefore the document represented as the "Trust Deed" would fall under the scope of this FOI request and I seek to be provided with a copy of this document.

of APRA's decision dated 4 October 2018 (FOI 19-5).

 

Your original request dated 14 August 2018 sought 'a copy of the founding
Trust Deed of the National Australia Bank Group Superannuation Fund A'.
The scope of your original request did not include a copy of the Trust
Deed provided to APRA for the purpose of its application for registration
of a registrable superannuation entity.

 

As such, we request that you withdraw your internal review request and
submit a new FOI request.
