FOI Request: FA 22/10/00496

Good afternoon BK

I refer to your request received on 10 October 2022 for access to a
document under the FOI Act.

The current due date for your request is 9 November 2022.

In order for the Department to complete the decision making process in
relation to this document that falls within the scope of your request, the
Department will require additional time to process your request.

The Department seeks your agreement under section 15AA of the FOI Act to
extend the timeframe for the processing of your request by 30 days, or an
agreed time period of your choice. If you are agreeable to 30 days, this
would extend the due date for your request to Friday 9 December 2022 and
assist the Department in managing its FOI caseload.

If you could provide a response to this request by close of business,
Monday 7 November 2022, or earlier if possible, it would be appreciated.

If you wish to discuss this matter further, please do not hesitate to
contact me on the details below.

Dear Lynette,

Thank you for your email. I do not agree with the extension of time. In my view this is a very simple request. If you disagree you can apply to the OAIC for an extension.

I believe it's the department's obligation to manage its caseload and process all FOI cases within the statutory timeframe.

Yours sincerely,

FOI Request: FA 22/10/00496

File Number: FA22/10/00496

Dear BK

I refer to your request to access documents under the Freedom of
Information Act 1982 (the FOI Act), which the Department of Home Affairs
(the Department) received on 10 October 2022.

As provided under section 29 of the Freedom of Information Act 1982 (the
FOI Act) and the Freedom of Information (Charges) Regulations 1982 (the
Regulations), I have determined that payment is required for this request
to be processed.

Preliminary assessment of charges

I have assessed the work the Department would need to do to process your
request, taking into account the time that would be spent by the relevant
business areas in searching for and retrieving documents and assessing the
documents for release. I have calculated the charge as follows:

Search and retrieval: (0 hours 38 minutes @ $15 per hour) = $9.50

Decision making: (1 hours 35 minutes @ $20 per hour) = $31.66

(no charges are applied for the first five hours of decision-making)

Total: $41.00

(charge has been rounded down to the nearest whole dollar amount)

Next steps

Within 30 days of this email you must:

•      pay the charge or optional deposit indicated in the attached
invoice for your request to proceed, or

•      write to the Department if you believe the charge has been wrongly
assessed, should be reduced or not imposed, or

•      withdraw your request.

Your request will not be processed until you take one of these actions.
Your request will be withdrawn if you do not take action with 30 days.

Option 1: Pay the charge or an optional deposit

You can either pay the full amount now, or a deposit of $20.00.

If you choose to pay a deposit, you will be liable to pay the remainder of
the charges once the Department has made its final decision on your access
request.

If you choose to pay the full charge or a deposit, you are deemed to have
accepted the Department’s decision to impose the charge.

If the Department does not make a decision on your request within the
statutory time limit, we will refund your payment.

Details of how to pay are contained in the attached invoice.

Option 2: Write to the Department to contend charges are incorrect or
should be waived or reduced

You can contest the charge on the grounds that the charge was not properly
calculated, or:

•          that payment of the charge, or part of it, would cause you
financial hardship

•          that giving access to the documents is in the general public
interest, or in the interest of a substantial section of the public.

This is not an exhaustive list and the Department may consider any other
relevant matters.

Please set out your reasons as clearly as possible and provide supporting
evidence.

The Department has a statutory timeframe of 30 days from the date of your
response to make a decision to reduce or not impose a charge. We will
notify you of our charges decision in writing.

Option 3: Withdraw your request

To withdraw your request, please send an email to
[1][Department of Home Affairs request email] or reply to this email stating that you wish to
withdraw the request.

If you withdraw your request, we will close your request and no charges
will be incurred.

Timeframe for your response

You must respond to this notice within 30 days, which is by Friday, 9
December 2022.

If you do not provide a written response within this timeframe your
request will be deemed withdrawn under section 29(2) of the Act. No
charges will be incurred.

Dear FOI Officer,

I refer to my FOI request FA 22/10/00496. As of today (11 Nov 2020), I have yet to receive any decision or document.

According to the Freedom of Information Act, it appears that you have failed to make a decision on my request within the statutory timeframe (30 calendar days + 1 day allowance for time spent waiting for my payment). As a result, you can no longer impose a charge on this request.

Accordingly, I now request that you kindly refund my payment. I would appreciate if the payment could be returned to the original payment method. Finally, I would also appreciate if you could continue to process my request and deliver the document before I initiate a review.

Thank you for your time and attention in this matter.

Kind regards,

Extension of time application by Department of Home Affairs

Dear BK

I write to advise that on 7 November 2022 the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Department of Home Affairs (Department) for an extension of time, to
process your FOI request of 10 October 2022.

Department has applied for an extension of time under s 15AB of the
Freedom of Information Act 1982 (Cth) because your request is considered
to be complex.

Department has advised the OAIC that:

·       The request is considered complex as review of the document for
exemptions identified sensitive material. This requires further internal
consultation with the relevant business area.

·       Further time is required to complete this internal consultation
before draft exemptions can be approved by a senior member of the
Department and a decision finalised.

Department has requested an extension to 9 December 2022. I will take any
comments you may have to make into account when deciding the application.

Please respond to this email by close of business 8 December 2022. If I
do not hear from you by this date, the decision maker will make a decision
on the basis of the information provided to me by the Department.

You will be notified of the decision once the matter has been finalised.

Further information about extension of time requests may be found on our
website at [2]Extensions of time.

If you have any questions regarding this email please contact me via email
to [3][email address]. Please quote OAIC reference: RQ22/04053 in all
correspondence.

Kind regards

Dear Noah Harris,

Thank you for your email regarding the Department of Home Affairs' application for an extension of time to process my FOI request. I understand that the Department has requested an extension until 9 December 2022.

At this stage, I neither support nor oppose the extension request as I have already received a response to my FOI request on 24 November 2022. The only consequence of your decision is whether or not my payment will be refunded in accordance with s 12(3) of the Freedom of Information (Charges) Regulations 2019.

Thank you for considering this matter and please contact me if any further information is required.

Yours sincerely,
BK

Dear Department of Home Affairs,

I am writing to formally withdraw my request for a refund in light of the OAIC's decision (RQ22/04053, FA 22/10/00496) to retrospectively grant an extension of time under s 15AB(2) of the Freedom of Information Act.

I understand that the OAIC has determined that my request was indeed complex and I respect their decision. Therefore, the grounds for my refund request no longer exist.

I appreciate your attention to this matter and thank you for your time.

Sincerely,
BK

FOI, Department of Home Affairs
