How much is the Technology One contract really costing us ratepayers?

I would like to know the real cost of the Technology One project and why it is taking so long to be completed.

Seek access of
1. Copy of the contract with Technology One
2. Declarations of interest for the Administrator Richard Pearson, the General Managers Rick Hart and Michael Deegan, Directors Peter Gainsford, Michael Zimoulas, John Warbourtane, Elizabeth Richardson, the Council and all information technology managers
3. Copies of adhoc disclosures of interest relating to the supplier, Technology One
4. Related Party Disclosures for the aforementioned people
5. How much money has been paid to Technology One so far
6. How much money is owing to Technology One
7. Why is the system running so late? All correspondence etc relating to this
8. All correspondence between Technology One and the Administrator, General Manager, Chief Executive Officer, all Deputy General Managers and directors and all information technology managers
9. Why is Inner West Council helping Technology One to develop the product? All correspondence about this arrangement and what the benefit is to the council
10. All material including text messages, emails, meeting minutes, indicating why Inner West made a decision to proceed with the Technology One product after it was obvious the product is not fully developed
11. All information about the staffing cost of this project including the permanent staff, temporary staff, outside consultants etc
12 what’s the real cost of the implementation including loss of productivity of staff working on this project for 3 years
13 information indicating when the system will finally be developed

information access application requesting information relating to the
contract between Technology One and Inner West Council (IWC).  You may
find it useful to know that in NSW the appropriate legislation for FOI
that is pertinent to your application with Council is the Government
Information (Public Access) Act 2009 (GIPA); Council will deal with your
information access application under the GIPA Act. 

 

The detail of your informal information access request is reproduced
below:

Your informal information access request is broad in scope and ranges
across disparate aspects of Council’s management of the Technology One
contract and one council technology solution project.  Some of the
information to which you have requested access is publically available via
Council’s website and I encourage you to view the information.  If after
doing so you may consider it appropriate to refine your information access
application request.

 

The GIPA Act 2009 requires that Council record and publish certain
information about some contracts with private sector bodies.  Part 3,
Division 5 of the Act states that information about contracts worth more
than $150,000 between Councils and private sector bodies must be recorded
in a register of government contracts.  See below:

Some further points of your informal information access request I can
respond to in this notice, see below, and may impact on any information
access application request clarification that you may consider appropriate
for resubmission. 

 

Point 15.

Council does not hold information concerning community engagement entered
into before council’s decision to contract Technology One, as Council did
not conduct any community engagement regarding the one council technology
solution contract.

 

Point 19.

Council does not hold information regarding tender documentation; council
did not perform a tender process for the one council technology solution. 
You may find it useful to view item 29 – IT System Consolidation (agenda,

I also wish to advise that points 7, 9 and 10 of your request are not for
data / information but are requests seeking comment by Council and as such
are not valid requests for information under the GIPA Act.  Council is
unable to respond to the points of request for comment under the Act, and
therefore you may wish to reconsider these points of your application for
relevance to the intent of your application for information, or you may
consider it appropriate to rephrase the request points for resubmission.

 

Additionally points 12, 13, 14 and 20 of your information access request
require reconsideration too for relevance to the intent of the information
access application, as these points are theoretical in concept seeking
notional data and measurements; in their existing format Council would be
unable to respond.  

 

If after viewing the available public material, and any reconsideration of
the information access application request points mentioned earlier, and
you wish to continue with the information access application under the
GIPA Act I will require that you submit it as a formal information access
application.  Further information regarding the GIPA Act and the
submission of a formal information access application can be found on

Please be minded that there is a $30 formal GIPA information access
application fee.  Section 41 of the ACT legislates how to make a valid
information access application and proscribes the requirements necessary
to so do.  I have reproduced, in part, this section if the GIPA Act below:

 

41 How to make an access application

(1) An application or other request for government information is not a
valid access application unless it complies with the following
requirements (the formal requirements) for access applications:

(a)  it must be in writing sent by post to or lodged at an office of the
agency concerned or made in the manner approved by the agency under
subsection (2),

(b)  it must clearly indicate that it is an access application made under
this Act,

(c)  it must be accompanied by a fee of $30,

(d)  it must state the name of the applicant and a postal or email address
as the address for correspondence in connection with the application,

(e)  it must include such information as is reasonably necessary to enable
the government information applied for to be identified.

 

I wish to draw your attention to the formal information access applicant
details required by s.41(1)(d) of the Act.  You may consider it
appropriate to submit your formal GIPA information access application via
another channel.  

 

I would also like to inform you that if the scale and the nature of the
informal application request is resubmitted unchanged as a formal
information access application there would be processing charges applied,
as proscribed by s.64 of the Act.  An agency, such as Inner West Council,
may impose a processing charge for dealing with an access application at a
rate of $30 per hour for each hour of processing time for the
application.  As determined at this instance, the processing charges would
be due as searching for and retrieving the information sought would
require a diversion of resources and time, as well as where the
information sought involves details of third parties who must be
consulted.

 

If point 8 and point 11 of the informal information access application
request were to be resubmitted unaltered as points in a formal GIPA
information access application request they would most likely be
determined as a substantial and unreasonable diversion of Council
resources and likely be refused.  You may wish to reduce the scale of
these points of the request.

 

So as to address the issues that I have raised concerning your application
request you may find it appropriate to discuss it with me before
proceeding further.

I will submit a formal information request to you next week. I will also review my request and will send you a revised list via this website. I am prepared to pay the $30 fee you are asking me to pay. Are you willing to waive the processing charges due to the nature of my request? Ratepayers have a right to know more about Inner West Council's expenditure and progress with amalgamation integration. There is hardly any information about this on your website.
