find it useful to know that in NSW the appropriate legislation for FOI
that is pertinent to your application with Council is the Government
Information (Public Access) Act 2009 (GIPA); Council will deal with your
information access application under the GIPA Act.

Your informal information access request is broad in scope and ranges
across disparate aspects of Council’s management of the Technology One
contract and one council technology solution project.  Some of the
information to which you have requested access is publically available via
Council’s website and I encourage you to view the information.  If after
doing so you may consider it appropriate to refine your information access
application request.

 

The GIPA Act 2009 requires that Council record and publish certain
information about some contracts with private sector bodies.  Part 3,
Division 5 of the Act states that information about contracts worth more
than $150,000 between Councils and private sector bodies must be recorded
in a register of government contracts.  See below:

Some further points of your informal information access request I can
respond to in this notice, see below, and may impact on any information
access application request clarification that you may consider appropriate
for resubmission. 

 

Point 15.

Council does not hold information concerning community engagement entered
into before council’s decision to contract Technology One, as Council did
not conduct any community engagement regarding the one council technology
solution contract.

 

Point 19.

Council does not hold information regarding tender documentation; council
did not perform a tender process for the one council technology solution. 
You may find it useful to view item 29 – IT System Consolidation (agenda,
recommendation and minute) Council Meeting 27^th September,

I also wish to advise that points 7, 9 and 10 of your request are not for
data / information but are requests seeking comment by Council and as such
are not valid requests for information under the GIPA Act.  Council is
unable to respond to the points of request for comment under the Act, and
therefore you may wish to reconsider these points of your application for
relevance to the intent of your application for information, or you may
consider it appropriate to rephrase the request points for resubmission.

 

Additionally points 12, 13, 14 and 20 of your information access request
require reconsideration too for relevance to the intent of the information
access application, as these points are theoretical in concept seeking
notional data and measurements; in their existing format Council would be
unable to respond.  

 

If after viewing the available public material, and any reconsideration of
the information access application request points mentioned earlier, and
you wish to continue with the information access application under the
GIPA Act I will require that you submit it as a formal information access
application.  Further information regarding the GIPA Act and the
submission of a formal information access application can be found on
Council’s website,

Please be minded that there is a $30 formal GIPA information access
application fee.  Section 41 of the ACT legislates how to make a valid
information access application and proscribes the requirements necessary
to so do.  I have reproduced, in part, this section if the GIPA Act below:

 

41 How to make an access application

(1) An application or other request for government information is not a
valid access application unless it complies with the following
requirements (the formal requirements) for access applications:

(a)  it must be in writing sent by post to or lodged at an office of the
agency concerned or made in the manner approved by the agency under
subsection (2),

(b)  it must clearly indicate that it is an access application made under
this Act,

(c)  it must be accompanied by a fee of $30,

(d)  it must state the name of the applicant and a postal or email address
as the address for correspondence in connection with the application,

(e)  it must include such information as is reasonably necessary to enable
the government information applied for to be identified.

 

I wish to draw your attention to the formal information access applicant
details required by s.41(1)(d) of the Act.  You may consider it
appropriate to submit your formal GIPA information access application via
another channel.  

 

I would also like to inform you that if the scale and the nature of the
informal application request is resubmitted unchanged as a formal
information access application there would be processing charges applied,
as proscribed by s.64 of the Act.  An agency, such as Inner West Council,
may impose a processing charge for dealing with an access application at a
rate of $30 per hour for each hour of processing time for the
application.  As determined at this instance, the processing charges would
be due as searching for and retrieving the information sought would
require a diversion of resources and time, as well as where the
information sought involves details of third parties who must be
consulted.

 

If point 8 and point 11 of the informal information access application
request were to be resubmitted unaltered as points in a formal GIPA
information access application request they would most likely be
determined as a substantial and unreasonable diversion of Council
resources and likely be refused.  You may wish to reduce the scale of
these points of the request.

 

So as to address the issues that I have raised concerning your application
request you may find it appropriate to discuss it with me before
proceeding further.

Dear Mr Hollands,

I refer to my request for processing fees to be waived. It is my view that the information I am seeking has a 'special benefit to the public generally' for the following reasons:

- requested information relates to Inner West Council's progress with amalgamation, particularly in the area of standardised systems. The topic of amalgamation was publicly debated for some time and many opposed to amalgamation cited the length of time it will take to form one council, particularly from 3 councils. Amalgations don't occur often and the public has a right to learn how Inner West Council is progressing with amalgamation.

- the requested information relates to the way Inner West Council used the monies granted from the NSW Government New Council Implementation Fund, see the report submitted to the council meeting on 27/9/16. Ratepayers have a right to know how Inner West Council is using the money provided by the state government.

- the decision to purchase the Technology One system without going to tender is very much of public interest. Government offices rarely do this and ratepayers have a right to know more about how this decision is impacting on Inner West Council.

- customers of Inner West Council have a right to know why after 3 years of amalgamation, they still cannot apply for the online services they had access to before amalgamation.

- ratepayers have a right to know if the decision to purchase the Technology One system without going to tender is going to cost them more because it is well overdue and has set Inner West Council back, much more than other amalgamated councils.

Dear Ms Smith,

 

Council received by post your formal GIPA information access application
form, see attached, and formal GIPA fee payment.  Unfortunately it is
invalid without a correct contact address to conduct communications
regarding the application; '[1][email address] via Right to Know
website' is an invalid email address for the purpose of a formal GIPA
application.  Council can use
[2][FOI #5570 email] which is associated with
your informal information access application REQ2019-063456 if you
prefer.  Please confirm that you wish communication regarding your formal
GIPA application to be conducted through the email address used for the
informal information access application or supply another contact address.

 

It is also noted on the formal GIPA application form that you used the
reference number REQ2019-063456, which is the reference to the 15^th
August 2019 informal information access application.  Without a valid
formal GIPA application to lodge the formal GIPA application fee is
currently accounted for against the informal information access
application REQ2019-063456.  When a valid formal GIPA application request
is submitted arrangements will be made to transfer the payment, for
accounting purposes, to the formal GIPA application reference number, yet
to be generated.

 

Council was unable to issue a receipt for the cash payment received as the
application did not contain a valid email address or street address. 

 

The formal GIPA application form also did not contain a valid request for
information as it was left blank.  You have since sending the formal GIPA
application form by post submitted via email on 29^th August 2019, see
attached, a revised list of information that you seek access to; a request
consisting of 14 points and is assumed to be the formal GIPA application
request.    Points 4 to 14 are in need of further clarification and
require refining to be considered for response and also enable the
disparate parts of your submission for a formal GIPA information access
considered valid. 

 

Kindly refine and / or clarify points 4 to 14 as “information about…” is
too broad and ill-defined to enable an appropriate information access
response.

West Council (IWC) you have submitted informal and formal application
requests.  The multi point application requests mostly contained invalid
points.  On several occasions I have asked that you refine and clarify the
invalid points of the submitted requests.  Your final 13 point application
request submission dated 19^th September 2019 also contains request points
that are invalid.  Council has decided that points 5 and 8 will not be
included in the determination to be issued in response to formal GIPA
information access application REQ2019-075259.  

 

Point 5 of the request, “reasons for the delay in implementing the
property and rating solution including but not limited to project plans,
announcements and revised agreed delivery times”, is a request for
explanation and not for data and therefore is not a valid request under
the GIPA Act.

 

Point 8 of the request, “Reasons for the decision to continue with the not
ready Property and Rating cloud solution instead of proceeding with the
established non-cloud property and rating system” is also a request for
explanation and not for data and therefore is not a valid request under
the GIPA Act.

 

If you wish to resubmit refined or clarified information requests that
would be valid under the GIPA legislation concerning points 5 and 8 you
may do so by lodging a separate GIPA information access application for
consideration by IWC.  

 

The remaining points are valid under GIPA legislation and will be taken
forward for response by IWC. 

 

In being cognisant of my earlier comments regarding points 5 and 8 of the
submitted request, I issue this notice to you as acknowledgement of a
valid submission of a formal GIPA information access request as referenced
REQ2019-075259.

 

You were informed on 19^th August 2019 that if the scale and the nature of
the informal application request were to be resubmitted substantially
unchanged as a formal information access application there would be
processing charges applied, as proscribed by s.64 of the Act.  An agency,
such as Inner West Council, may impose a processing charge for dealing
with an access application at a rate of $30 per hour for each hour of
processing time for the application. 

 

As determined at this instance the initial estimated processing charge is
based on providing access in response to your application and my reckoning
for this charge is give here:

 

1.Time spent handling your application to date, including preliminary
searches and internal consultation: 9 hours at $30 p/h = $270;

2.Time for searches and information retrievals, interrogation and analysis
of found information expected further searches, internal consultation and
contributions by others, decision making and other functions in connection
with deciding the application: 20 hours at $30 p/h = $600;

3.Preparation of the determination: 3 hours at $30 p/h = $90; and

4.Minus the $30 formal GIPA application fee already paid by you: 1 X $30
fee  = -$30.

5.Total processing charge to determine this formal GIPA application (a)
$270 + (b) $600 + (c) $90 – (d) $30 = $930

 

On 1^st September 2019 you submitted a request that Council waive the
processing charges providing reasoning that the formal GIPA information
access application has special benefit to the public generally.  I have
considered your processing charge waiver request under s.66(1) of the Act;
I have decided that you are entitled to a 50% reduction in the processing
charge and that I am satisfied that the information applied for is of
special benefit to the public generally. 

 

The discount applies only to the processing charge, not the application
fee.  If a 50% reduction in processing charge applies, the application fee
will pay for the first 2 hours of processing time, not just the first hour
as permitted by s.64 of the Act.

 

Therefore the processing charge imposed to determine this formal GIPA
application is adjusted as follows: 50% reduction applied to total (5)
$930 = $465

 

Under s.64(1) of the GIPA legislation an agency may by this notice require
you, the applicant, to make an advance payment of the processing charge as
an advance deposit.  Section 69(1) of the legislation requires that an
advance deposit of 50% of the amount that the agency estimates to be the
total processing charge for dealing with the application can be imposed. 
Therefore you are requested to pay to IWC an advance deposit of $232.50,
being 50% of $465.   At this point, if you are so inclined, you can pay
the processing charge in full ($465); so as to avoid the necessity to
later pay the outstanding processing charge amount that would be required
prior to the release of the determination in response to the information
access application.

 

Please contact a council customer service office (T: 02 9392 5000) to make
the $232.50 advance deposit payment or the full processing charge of $465
by card; or visit a council customer service centre, address below, to
make the payment in person; or send a cheque by post.  For your own peace
of mind and to avoid the risk of loss IWC does not recommended that you
send cash through the mail.

 

Please remember to quote the reference number REQ2019-075259 in any future
communication regarding your formal GIPA application. 

 

Please be minded that the 20 working day period within which the
application is required by the legislation to be decided stops running
from when the decision to require an advance deposit is made until the
payment of the advance deposit is received by the agency, s.64(2) of the
Act. 

 

I advise that if information that would be of interest to other members of
the public is released in response to a formal access application, an
agency must record certain details about the application in its
‘disclosure log’ (under s.25 and s.26 of the GIPA Act).  I give notice
that I have decided that this information access application will be
included in IWC’s disclosure log.

   

I am advising you of your right to object to the inclusion of details
about your access application in the disclosure log, in certain
circumstances (for example, if you seek access to your own personal
information).  It may be decided after consultation and objections made
that the information would be of interest to other members of the public
and will therefore record the following details in our disclosure log,
which is publicly available on our website:

 

o the date on which your access application was decided (that is, the
date of the notice of decision);
o a description of the information that will be released to you;
o whether that information is or will be available to other members of
the public; and
o if so, how it can be accessed.

 

I advise that certain formal GIPA application decisions are reviewable
under the GIPA legislation and that some of the decisions that have been
made and that will be made regarding a valid formal GIPA information
access application are reviewable under section 80(m) of the GIPA Act.  If
you disagree with any of the decisions that IWC makes in processing your
formal GIPA application or IWC’s handling of your application that are
reviewable, you may seek a review under Part 5 of the GIPA Act. Before you
do so, I encourage you to contact me to discuss your concerns.  My contact
details are set out below.

 

You have three review options:

 

·         internal review by another officer of this agency, who is no
less senior than the determining officer;

·         external review by the Information Commissioner; or

·         external review by the NSW Civil and Administrative Tribunal
(NCAT).

 

You will have 20 working days from the date of determination notice to
apply for an internal review. If you would prefer to have the decision
reviewed externally, you have 40 working days from the date of the
determination notice to apply for a review by the Information Commissioner
or NCAT.

On 25^th September 2019 an acknowledgement was issued to you confirming
the lodgement of a valid formal Government Information (Public Access) Act
2009 (GIPA) information access application.  

 

The acknowledgement also contained information regarding a processing
charge and request for an advance deposit payment of $232.50 as per
s.64(1) of the GIPA legislation, being 50% of the processing charge
reckoned at $465 and included a reduction due to your processing charge
waiver request.  To date Council has not received your payment.  I wish to
give notice that should Council not receive payment of the advance deposit
by close of business on 11^th October 2019 then the access to information
application REQ2019-075259 will be considered withdrawn, as per s.50 of
the GIPA Act.

 

Please be minded the withdrawal of an application does not entitle the
applicant to a refund of any application fee or advance deposit already

On 25^th September 2019 an acknowledgement was issued to you confirming
the lodgement of a valid formal Government Information (Public Access) Act
2009 (GIPA) information access application.  On 9^th October 2019 a
further correspondence reminded you that Council awaited payment of the
advance deposit and requested payment of the deposit to be made by close
of business on 11^th October 2019 and that to not do so would deem the
application withdrawn.    

 

Payment of the advance deposit has not been made; therefore I notify
confirmation to you under s.50 of the GIPA legislation that information
access application REQ2019-075259 is withdrawn as at 11th October 2019.  I
similarly confirm that the withdrawal of an application does not entitle
