Hi,

I have reviewed the documents relating to this request, and have found that the request was published on our disclosure log in error.

The Freedom Of Information Act at s 11C provides that we must publish a disclosure log except in the case where the information is about the business, commercial, financial, or professional affairs of any person and it would be unreasonable to publish this information.

Having reviewed the information it relates to the evaluation of Requests for Quotation and other commercial information relating to a single company. While the disclosure log references comments on the DTA website, these were actually commentary written by DTA officials, and correspondence from the company made through a function on the Digital Marketplace website. The request was made by the company in question, seeking access to information about themselves, which meant the FOI request could be granted to them but not to others. It is commercial information about that company, and to reveal that information used in bidding for work would not be reasonable.

For this reason we will not be providing the documentation as provided in s 11C(1) of the FOI Act.
