Infringement Notice or notices, Court enforceable undertakings

JS made this Freedom of Information request to Australian Competition and Consumer Commission

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was partially successful.

Dear Australian Competition and Consumer Commission,

At page 104 of the ACCC ANNUAL REPORT 2014/15 ( covers operations for the year ended 30 June 2015} the following information is set out:

" In 2014−15, the ACCC finalised three product safety enforcement matters associated with the supply of household cots that did not comply with the mandatory safety standard.

The ACCC issued infringement notices to Le Tian (trading as SavingForAussie), New Aim Pty Ltd (trading as OzPlaza.Living) and Toys “R” Us Australia Pty Ltd. The companies provided court enforceable undertakings for supplying household cots in breach of s. 106 of the ACL."

Further information is provided in page 105 about the traders other than New Aim Pty Ltd.

Under FOI I seek access to a copy of the infringement notice or notices issued to New Aim Pty Ltd (trading as OzPlaza.Living) and a copy of the court enforceable undertakings provided by the company.

Yours faithfully,

JS

FOI, Australian Competition and Consumer Commission

Dear FOI,

Thank you for the ack letter.

In the executive summary dated 2 Oct 2015 of the Annual Report 2014/15 there is a statement “This report covers operations for the year ended 30 June 2015 “. I assume the period covered by the annual report to be 1 July 2014 to 30 June 2015.

You referred me to undertakings on the website that were offered and accepted prior to 30 June 2014. Indeed the undertakings are referred to in the 2013/2014 annual report - a report covered operations ended 30 June 2014.

Yours sincerely,

JS
