Many thanks for your email requesting documents under the Freedom of
Information Act 1982 (the FOI Act).

 

I note you have requested access to the following documents:

 

“A copy of all John Lyons messages sent and received from the device he
used to tweet during the AFP search warrant at the ABC HQ. I am requesting
all messages on any platform for the duration of the warrant execution and
for 2 hours after.”

 

The 30-day statutory period for processing your request commenced from the
day after your application was received, being 1 August 2019. Subject to
any suspension of the processing period or extension of the time for
deciding this application, the ABC is required to make a determination in
relation to this application by 30 August 2019.

information on its website within 10 working days after the release of the
documents to the FOI applicant.

I refer to your request for access to documents under the Freedom of
Information Act 1982 (the FOI Act).  

I have taken reasonable steps to identify and retrieve all documents
relevant to your request, and as a result of those searches, nine
documents have been sent to me for assessment.

In my view, several of those documents contain information about a person
who might reasonably wish to make a contention that the documents are
conditionally exempt under section 47F (personal privacy) or 47G (business
information) of the FOI Act, and that access to that document would, on
balance, be contrary to the public interest for the purposes of section
11A(5).

In those circumstances, I am required to give each of these individuals a
reasonable opportunity to make submissions in support of such a
contention, and to have regard to any submissions that are made.

The ABC was to have made a decision in this matter by 30 August 2019. In
accordance with section 15(6) of the FOI Act, the period of time to notify
you of a decision is extended by a further period of 30 days to enable
that consultation to occur. This means that, subject to any suspension of
the processing period or further extension of the time for deciding this
application, the ABC is required to make a determination in relation to
this application by 30 September 2019.
