NDIA’s Audit and Risk Committee/Risk Committee Minutes of Meeting for financial year 2016-17

The request was refused by National Disability Insurance Agency.

Dear National Disability Insurance Agency,

Please provide copies of all Audit and Risk Committee (ARC) Minutes of Meeting (from July 2016-February 2017) and the newly established Risk Committee (February 2017-June 2017) Minutes of Meeting for the financial year 2016-17, cited in the NDIA 2016-17 Annual Report [1]. That is, the total of both committees for the full financial year 2016-17. This includes all attendees, agenda, topics and resolutions/outcomes.

Context:

“Risk Committee: The Risk Committee assists the Board in the management and oversight of the Agency’s approach to risk management. The role of the Risk Committee is to advise the Board in relation to the development and implementation of the NDIA’s overall risk management approach. Board members on the Risk Committee are Mr Jim Minto (Chairman), Ms Robyn Kruk AM, Mr Martin Laverty and Mr Paul O’Sullivan” [2]. This newly formed committee follows the announcement that “The Audit, Risk and Finance Committee (ARFC) operated until 31 December 2016, when it was replaced by a dedicated Audit Committee and Risk Committee. Board members on the Audit, Risk and Finance Committee were Mr John Hill PSM (Chair), Ms Geraldine Harwood and Mr Martin Laverty. The ARFC also had two independent members, Ms Marian Micalizzi and Ms Helen Williams AO” [3].

Thank you for your help with this request.

Yours faithfully,

Shirley

Extension of time application by the National Disability Insurance Agency

Dear Shirley

I write to advise that on 12 August 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
National Disability Insurance Agency (the NDIA) for an extension of time
to process your FOI request made on 13 June 2021.

The NDIA has advised the OAIC that you agreed to an extension of time to
process the request under s 15AA of the FOI Act to 12 August 2021 (OAIC
reference RQ21/01847).

The NDIA has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your request is considered to be
complex and voluminous.

·     The NDIA has advised the OAIC that:

−     the request is broadly scoped and covers both current and historical
documents

−     the request seeks access to documents of a highly sensitive and
complex nature from multiple business areas

−     the NDIA is engaged in a significant amount of consultation with
multiple stakeholders to ensure it has appropriately identified documents
within scope, and determine whether it needs to further engage with you

−     searches for historic material have been complex as ICT
infrastructure has changed over time and other Commonwealth agencies hold
the archived material, and

−     the NDIA is committed to issuing a decision as soon as possible.

The NDIA has requested an extension to 12 September 2021. I will take any
comments you may have to make into account when deciding the application.

Please respond to this email by close of business 17 August 2021. If I do
not hear from you by this date, I will proceed to make a decision on the
basis of the information provided to me by the NDIA.

You will be notified of the decision once the matter has been finalised.

Further information about extension of time requests may be found on our
website at [2]Extensions of time.

Yours sincerely
