Dear Mr Ali,

I refer to your email dated 18 June 2022 in which you request access to documents held by the Department of Home Affairs (the Department) under the Freedom of Information Act 1982 (the FOI Act).

I am writing to advise that your request is not valid for the purposes of section 15(2)(b) of the FOI Act in its current form, and to provide you with an opportunity to revise your request so that it is a valid request. Reasons for practical refusal
The Department has considered the scope of this request and its capacity to conduct searches of relevance based on the current scope. It is my preliminary view that your request, in its current form, is not specific enough to enable the Department to identify documents in scope of your request.

In order to process your request in a timely manner, FOI and the relevant business area require your assistance to clarify the scope of your request.

Please clarify whether the phrase 'number of people waiting' refers to approved applicants.
Also, please confirm if the exact date for which you require the requested information. For example, 18 June 2022.

I am not sure why my request is invalid as I had actually got the idea from a similar request made earlier by someone else regarding same question for Burwood council (NSW) which was responded to with the required information.

I will therefore not want to revise it as this kind of query has previously been responded to by the department with positive response I.e. provided requested information

Invalid Freedom of Information internal review request

Thank you for your email requesting an Internal Review of your Freedom of
Information request FA 22/06/01064.

The Department has determined that your request for internal review is
invalid, by the operation of section 54E(b) of the Freedom of Information
Act 1982 (the FOI Act).

Section 54E(b) provides that internal review is not available for
decisions that an agency has been taken to have made under section 15AC of
the Act.  Section 15AC of the FOI Act applies when an agency is deemed to
have refused an FOI request because it did not make its original decision
on the request during the request’s statutory timeframe (30 days, plus any
additional time the FOI Act provides for extension or consultation).

On 24 June 2022 you were provided a Practical Refusal Notice, which
advised you that the Department has considered the scope of this request
and its capacity to conduct searches of relevance based on the current
scope. It is my preliminary view that your request, in its current form,
is not specific enough to enable the Department to identify documents in
scope of your request.

You have the opportunity to respond to this Practical Refusal as outlined
in this letter.

The Department can only conduct internal reviews on previously made
decision. As the Department is awaiting your response to this Practical
Refusal Notice, we are unable to take action on your request for internal
review.

Request Consultation Process

You now have an opportunity to revise your request to enable it to
proceed.

Timeframe for receiving your decision

Preliminary assessment of charges

This email is to advise you that I have made a preliminary assessment that
you are liable to pay a charge in respect of the processing of your FOI
request in accordance with s.29 of the FOI Act.  Please see the attached
notice for further information.

The FOI Act provides you with 30 days to respond, in writing, to this
notice, which is close of business Thursday, 18 August 2022.

Details on how to make a payment to the Department are included in the
notice. Please ensure that you include your FA reference number with your
payment. If this information is not included with your payment details it
may delay the processing of your request.

Please note if you make the payment by EFT, please advise the FOI section
at [2][Department of Home Affairs request email] immediately to avoid delays in the processing
of your payment.

Please also advise if you wish to withdraw your request to enable
cancellation of the invoice.
