NSW Police and Malicious Prosecution

We're waiting for Lauren Ainslie to read a recent response and update the status.

Dear NSW Police Force,

I just wanted to find out directly from you, what elements need to be established in order to charge someone with a serious indictable offence in NSW?

Can a citizen be arrested for the only purpose of obtaining their phone?

How often is someone arrested for a serious indictable offence without sufficient, if any at all, evidence?

Surely there has to be elements that satisfy the definition of reliable evidence, in order to fill the requirements needed to charge someone?

What I see happening and what I read are supposed to happen, are two very different things, so I am writing to you so that you can provide me with clarification.

Dear Sir/Madam,

Thank you for your inquiry to the NSW Police Force, I can confirm this is the correct avenue to obtain this information.

In order to make a request for NSW Police Force information, an applicant is required to submit a completed 'Formal Access' application under the Government Information (Public Access) Act 2009.

As from 30 July 2020, the New South Wales Police Force accept applications for access to information online through the NSW Police Force Community Portal Simply select the Access to Information card under the I want to apply section on the homepage and follow the questions presented.
Below are instructions to submit an application online:

In your browser, type: portal.police.nsw.gov.au, then Enter.
You will be in the NSW Police Community Portal.
At the bottom of the screen, select “Access to Information”.
In the next screen, select “Continue”.
In the next screen, in the dropdown box, select “New Access Application”.
You will be asked 6 questions – Yes/No answers are required. If you are unsure, answer No, then continue on with the application.
There is a $30 application fee payable by credit card.
When completed, submit the application.

PLEASE NOTE REQUESTS MADE VIA EMAIL ARE NOT ACCEPTED .

Good morning,

 

Thank you for your email. To lodge an internal review it must be received
within 20 days of the date of decision and you must provide certain
information, such as your GIPAA reference number and the reason you are
applying for internal review. 

 

I can see you have lodged a number of applications, which have been
invalid due to no payment. The NSW Police Force are only able to receive
GIPA Access applications by the [1]NSW Police Force's Community Portal or
by mail with a completed application form and accompanied by the relevant
fee. Internal Review applications must be received in the same method as
the access application. i.e if you lodged the GIPA Act access application
through the Community Portal, the Internal Review application must be
received through the Community Portal also.

 

If you have any further questions, please do not hesitate to reply to this
