Dear Mr Mesman,

I am requesting the charge imposed ($30) be waivered on public interest grounds.
(The $30 has been paid in the interim to allow continued processing of the FOI request while the waiver request is being reviewed.)

Reasons for the waiver request are outlined below.
1. The scope of the request is for the number of premises mapped to Skymuster within a 25km radius of a Capital City's GPO.
2. Any premises within 25km/h of a Capital City would not (by any reasonable definition) be considered Regional, Rural or Remote.
3. NBNco in all it's published literature regarding Skymuster (websites and hard copies), including social media posts by NBNco hosted on 3rd party websites and blog posts hosted on NBNCo's websites refer to Skymuster as delivering "the nbn™ broadband access network to homes and businesses in regional and remote Australia"
4. NBNco's CTO in a blog post dated 5 July 2017 implies that "outer suburban areas cannot be shoved onto Skymuster - NBNco must preserve this capacity for Regional and Remote Australians"
5. If premises within a 25km radius of a Capital City's GPO (these could reasonably be defined as "outer suburban areas") are mapped for Skymuster, this demonstrates NBNCo are misinforming the public in regards to how Skymuster is being used to conenct premises to NBN's network.
6. If NBNCo are misinforming the public, this is of public interest.

Yours sincerely,

BIFMA

To whom this may concern (BIFMA) – I am informed by the Right-to-Know
(RTK) moderators that it is the responsibility of individual requestors to
change the status of their requests, rather than that of the RTK
moderators.

I note the annotation on the file indicating that the application was
successful but the request for a fee waiver was refused, however, the
status is listed as “refused.”

I would ask that you please change the status to successful, noting that
information was released per the attached FOI decision, below.

Thank you and best regards, David Mesman

BIFMA left an annotation ()

Note: The request to refund the FOI fees was (unsurprisingly) refused. The FOI request itself was successful.
There is no facility on this website to mark the request as successful with other issues relating to the request (such as refund of fees) as refused.
The fees relating to this FOI request were not refunded upon request, meaning the last request made to NBN in relation to this FOI was refused.
BIFMA is therefore marking this request as refused.
Again, BIFMA acknowledges their FOI is successful and that the information they requested in their FOI is published both on this website and NBN's website/FOI disclosure log.

Dear David Mesman,

I note this FOI request has made news on the iTNews website: https://www.itnews.com.au/news/nbn-co-re...

Within that article it states:
"The FoI reveals there are 1033 premises connected to Sky Muster....
iTnews has confirmed these are all premises with active Sky Muster connections."

We are concerned that the FOI information released is not what was requested.

The FOI submitted requested information on all premises mapped for Skymuster within 25km of the GPO in each Capital City. "Mapped" meant all premises that are mapped to recieve Skymuster (whether connected or not), not just active connections to Skymuster.

This should have either been self evident (as we would have requested "active connections" if we had wanted that information) or the request clarified by NBNCo prior to release.

Can you please provide either:

> An assurance the information released in the FOI is for all premises mapped for Skymsuter, and not just active connections;
> If the information released only provides for active connections, an update to the FOI providing information on all premsies mapped to receive Skymuster (whether the connection is active or not).

Yours sincerely,

BIFMA

Dear NBN Co Limited,

Please pass this on to the person who conducts Freedom of Information reviews.

We are writing to request an internal review of NBN Co Limited's handling of my FOI request 'Number of premises mapped for Skymuster within 25km of a Capital city.'.

We had requested:
"how many premises are mapped for a Skymuster connection (as at 12/11/2019) within a 25km radius of the GPO in each Capital City for each State?
(NT & ACT are excluded from this request)
Please breakdown the number of premises by each City.
Eg;
Sydney: ###, Melbourne: ###, Brisbane: ###, Perth: ###, Adelaide: ###, Hobart: ###."

According to the published news report on iTNews, NBNCo has confirmed the information actually supplied for the FOI request was for premises "connected" to Skymuster within a 25km radius of the GPO in each Capital City for each State. This is not what was requested in the FOI and was not what we were lead to believe was supplied by NBNCo in the FOI.

https://www.itnews.com.au/news/nbn-co-re...

We would like this request reviewed please, and details provided as to why the wrong information was supplied for the FOI request.

We would also like the correct information released (at no additional cost), namely, all premises mapped to recieve a Skymuster connection within 25km radius of the GPO in each Capital City for each State.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/n...

Yours faithfully,

BIFMA

David Mesman, NBN Co Limited

To whom this may concern (BIFMA) - I apologise for not reverting earlier this week. I was unwell and away from work.

I confirm that that data provided was in relation to active Sky Muster™ connections. For reference, nbn does not use the term “mapped” to describe unconnected or inactive premises. nbn will consider your request for unconnected or inactive premises designated as Sky Muster™ connections in current nbn™ network deployment planning.

nbn will not charge you for the processing of this request for additional information, noting the confusion regarding the original terms. We will revert to you as soon as possible. Please note that nbn’s FOI Team will need to consider whether the additional data relates to nbn’s commercial activities and/or whether the data may be exempt from release.

Best regards, David Mesman
