OAIC's investigation of 2025 NDIA FOI complaints
Dear Office of the Australian Information Commissioner,
Under the FOI Act, I request access to the whole of the following documents concerning the NDIA 2025 Complaints (as defined in the "Particulars" section of this email):
1) A document indicating why the complaints would be investigated.
2) The "investigation notice(s)" sent to the National Disability Insurance Agency (NDIA) in relation to the complaints.
3) The NDIA's response to the investigation notice(s).
4) Any subsequent requests for information sent to the NDIA after its initial response to the investigation notice(s), including responses to the requests.
5) A document containing the OAIC's assessment of the complaints, after taking into account the material provided by the NDIA.
6) The submission provided to the OAIC decision maker for the complaints, recommending they make findings or determine an outcome for the investigation.
7) The "Notice on completion" dated 28 November 2025 concerning the complaints and sent to the NDIA (including any covering letter/email).
8) The NDIA's response to the Notice on completion.
9) Correspondence between the OAIC and NDIA after the NDIA's response to the Notice on completion, which relates to the complaints and the OAIC's recommendations.
Particulars:
* The OAIC's website contains an "Outcomes of investigations summary table" for FOI complaints. The table contains an entry naming the NDIA as respondent for six FOI complaints which were "progressed ... together" and resulted in a "Notice on completion" dated 28 November 2025.
* In this request, the term "NDIA 2025 Complaints" refers to those six FOI complaints. If the complaints were aggregated into a single complaint at the investigative stage, the term refers to that aggregated complaint.
I agree to the OAIC excluding draft documents and information identifying the complainants for the NDIA 2025 Complaints from this request.
I also agree to the OAIC removing as irrelevant mobile telephone numbers, direct internal contact details and names of OAIC staff below SES level from any documents released.
