We’re sorry to let you know that it’s taken us longer than expected to
process your request. This is because we require additional consultation
with relevant business areas within the National Disability Insurance
Agency (NDIA), in order to make a robust decision on access, however the
lockdown imposed to many states where the NDIA operates has caused delays
to our Agency operations.
We are therefore writing to seek your agreement to a 17 day extension of
time under section 15AA of the FOI Act.

Extension of time application by National Disability Insurance Agency
Dear Ms Humphries
I write to advise that on 14 October 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
National Disability Insurance Agency (the NDIA) for an extension of time,
to process your FOI request of 14 October 2021.
The NDIA has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your request is considered to be
voluminous and/or complex.
The NDIA has advised the OAIC that:
o the NDIA considers this request is complex as it relates to internal
documents held by NDIA Staff and line areas
o this request for information was received by the NDIA along with a
large number of other significant requests within a short timeframe
o a number of consultations about documents and sensitivities are still
ongoing in order to formulate a robust decision on access, and
o the processing of this request has been impacted by the stay at home
orders.
The NDIA has requested an extension to 5 November 2021. The decision
maker will take any comments you may have to make into account when
deciding the application.
Please respond to this email by close of business 21 October 2021. If I do
not hear from you by this date, the decision maker will proceed to make a
decision on the basis of the information provided to me by the NDIA.
You will be notified of the decision once the matter has been finalised.
