Pergola on the side (next to road side fence)

Dear Wyndham City Council,

I am wondering if I can construct a pergola on the side of my dwelling. It is a corner property so, the pergola would be build in the side next to the road. ( Not exactly next to the road, there's food path and nature strip inbetween my fence and the road).

What are the things I should follow ?
Can you please let me know where can I get more info on this ?

Thank you for your email to Wyndham city council – Building Services.

 

I have listed all the requirement ( 1-roofed structure and 2-unroofed
structure) for the building permit exemptions :

 

If the requirements are more than the below points then you will require
building permit:

 

1.            FREE STANDING CLASS  10a – Is a building permit required?
Shed example

 

Assuming the proposed garden shed will be located on side or rear of the
property and there is a dwelling on the same allotment, a building permit
is not required if the following parameters are met:

 

•             Should be a free-standing structure – no support on the
existing dwelling.

•             Floor area does not exceed 10 square metres.

•             Height does not exceed 3 metres in height (if set back from
the boundary more than 1 metre).

•             Height does not exceed 2.4 metres in height (if proposed
within 1 metre of the boundary).

•             Is not constructed of masonry.

•             The consent letter from the service authorities may be
required if the construction is proposed over the easement.

•             Clarify with your estate/ corporate / developer/ (in any)
whether your property required their approval.

•             Clarify if planning permit approval is required for your
allotment.

 

 

2.            PERGOLA – Is a building permit required?

 

•             A pergola is defined as unroofed structure with a permeable
roof. Water needs to be able to pass through to the ground surface.

•             You will not require a building permit if the pergola does
not exceed 3.6 m in height and 20 metres square in floor area.

•             The pergola must also not encroach more than 2.5 into the
front setback of the dwelling.

•             Any construction within 1 m of an easement may require
consent from the relevant authority. Please also ensure that a planning
permit is not required to construct the proposed structure and there are
no title restrictions.

•             Pergola can be attached to your existing building
