were sent between the Dept and the Minister/Minister’s Office. If so, it

would in effect include any and every document on the subject, including
correspondence/documentation concerning planning for the review, the
contract and procurement processes for the external reviewer, other
routine correspondence, meeting invitations and so on. It is likely that
this would not be reasonably practical for the Dept to process and may
attract a practical refusal notice pursuant to section 24AA of the FOI
Act.

 

We seek your clarification about the correct interpretation of your

Notice of Third Party Consultation

 

Documents have been identified in the scope of your request which contain
information relating to third parties. It has been determined that it
would be appropriate to consult with the affected third parties under
section 27 of the FOI Act prior to a decision on access to those documents
being made.

 

Section 15(6) of the FOI Act allows the timeframe for processing your
request to be extended by 30 days to facilitate this consultation. We note
that the request was placed on hold between 13 November and 14 November to
undertake consultation with you regarding the scope of the request.
Accordingly, the statutory due date for your request is now 8 January
2023.
