Dear Ms D

I refer to your FOI request 4805.

The Department of Health and Aged Care would like to clarify your request.

Your request may be intended to focus on documents held by the Dept that
were sent between the Dept and the Minister/Minister’s Office. If so, it
could be interpreted or rephrased as:

The final report.

Also any correspondence, including briefs, emails including and other
documents held by the Department of Health and Aged Care:

- Between the Department of Health and Aged Care and the Office of the
Minister for Health Aged Care; or

- Between the Department of Health and Aged Care and the Minister for
Health and Aged Care;

regarding the Post-listing Review of Surgical Guides and Biomodels
currently listed on the Prostheses List, between 1 July 2022 – 3 November
2023.

However, if you are seeking:

Any correspondence, including briefs, emails and other documents:

 1. Held by the Department of Health and Aged Care;
 2. Between the Department of Health and Aged Care and the Office of the
Minister for Health Aged Care;
 3. Between the Department of Health and Aged Care and the Minister for
Health and Aged Care;

regarding the Post-listing Review of Surgical Guides and Biomodels
currently listed on the Prostheses List, including the final report
between 1 July 2022 – 3 November 2023.

this would potentially capture a very large number of documents, as it
would in effect include any and every document on the subject, including
correspondence/documentation concerning planning for the review, the
contract and procurement processes for the external reviewer, other
routine correspondence, meeting invitations and so on. It is likely that
this would not be reasonably practical for the Dept to process and may
attract a practical refusal notice pursuant to section 24AA of the FOI
Act.

We seek your clarification about the correct interpretation of your
request by COB Wednesday 15 Nov 2023.

Yours sincerely

Guy
