James Smith made this Right to Information request to Tasmanian State Ombudsman and Health Complaints Commissioner as part of a batch sent to 204 authorities

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Dear Tasmanian State Ombudsman and Health Complaints Commissioner,

This is a request under the Freedom of Information Act.

I request documents related to the ten most recent instances where an employee has sought information, advice, guidance, or opinion on their social media use in a private capacity.

I limit the scope of documents to:
- the original request from the employee
- the agency/department's response
- any follow-up questions and response
- only those sent to a relevant HR / conduct / social media (or similar) team (rather than managers across all areas of the organisation)
- where the original request was created in the last 2 years

Should you have any questions please do not hesitate to contact me.

Yours faithfully,

James Smith

Cain, Mike (OHCC), Tasmanian State Ombudsman and Health Complaints Commissioner

Hi James,

Thanks for your request below under the Tasmanian Right to Information Act 2009. Under s6, it provides the Act does not apply to information in the possession of certain persons or public authorities, in or in the possession of a person whose services are provided or procured for the purposes of assisting the person or public authority, unless the information relates to the administration of the relevant public authority.

Specifically, under s6(1)(j) - the Ombudsman is an excluded person/body.

I would recommend that you submit an application for assessed disclosure to the public authority or authorities to which you would like to find this information. If after the relevant process have been followed with that public authority and you are unhappy with either the internal review decision or a decision made by that public authority's principal officer, you may submit it to this office for an external review.

I hope this helps. If you have any questions, please do not hesitate to contact me.

Regards,
Mike
