Timeframes

The statutory due date for you to receive a decision on your request is 15
June 2023. This date may be extended in certain circumstances, and in the
event that this occurs, the Department will notify you.  Where the due
date falls on a Saturday, Sunday or public holiday, the timeframe will
expire on the next working day.

I refer to your request for access to documents held by the Department of
Infrastructure, Transport, Regional Development, Communications and the
Arts (the Department) under the Freedom of Information Act 1982 (FOI Act).

Notification of Third-Party Consultation and Extension of Time

Your request captures documents which contain another individual’s
personal information and information concerning the business, commercial
or financial affairs or an organisation, or a person’s business or
profession affairs. Under section 27A and section 27 of the FOI Act, the
Department is required to consult with the affected person or
organisation before making a decision on access to those documents.

For this reason, the period for processing your request has been extended
by 30 days under section 15(6) of the FOI Act in order to allow the
Department time to consult with the relevant person or organisation. As
such, the statutory due date for your request is now 15/07/2023.

The consultation mechanism under section 27A applies when we believe the
individual (or their representative) may wish to contend that the
requested documents are exempt for reasons of personal privacy.

Good afternoon Dr Terhorst

 

On 16 May 2023, you requested access to documents held by the Department
of Infrastructure, Transport, Regional Development, Communications and the
Arts (the Department) under the Freedom of Information Act 1982 (the FOI
Act).

 

The Department requires additional time to be able to complete the
processing of your FOI request to ensure that it is as fulfilled and well
informed as possible. Several Commonwealth Agencies have been identified
within the documents relating to your request. Consultation with these
Agencies is required, unfortunately the FOI Act does not allow an
additional extension of time for inter-agency consultation.

 

Section 15AA of the FOI Act which enables the Department to seek your

requesting a 30-day extension.

Good Afternoon Dr Terhost,

Thank you for your email of 7 July 2023 in response to our request for an extension of time to continue to process your FOI request.

The FOI Act provides for an initial period of 30 days to make a decision on access in a request. However, this initial period may be extended in a number of ways under the provisions of the FOI Act.

Section 27A and section 27 of the FOI Act requires the Department to consult with affected third parties before deciding on access to documents which contain personal information or business information about an organisation. This consultation mechanism applies when we believe the affected third parties may wish to contend that the requested documents are exempt from disclosure under the relevant provisions of the FOI Act.

For this reason, the initial period for processing your request was extended by 30 days under section 15(6) of the FOI Act in order to allow the Department time to consult with the relevant affected third parties , and we notified you of that consultation extension on 8 June 2023, as required by the FOI Act.

As the decision maker has progressed your request and is assessing the documents captured by it, they have identified further consultations that should occur, with other Australian government agencies. The Guidelines issued by the Office of the Australian Information Commissioner (OAIC) state, at paragraph 3.70, that it is good practice to consult with other relevant agencies, even when the FOI Act does not require consultation.

Although the FOI Act does not provide for additional time to consult with the Australian government agencies, section 15AA does state that the Department may extend the period for dealing with a request, by a further period of no more than 30 days if the applicant agrees in writing to the extension.
Our email to you of 7 July sought your agreement to that extension to facilitate that consultation. You did not agree to this extension. As such, due to the complexity of this request, the Department will apply to the OAIC under section 15AB of the FOI Act for an extension of the statutory timeframe because the current period of time is insufficient for the Department to deal adequately with the request due to its complexity.

The Department has complied with the provisions of the FOI Act at all times during the processing of your request and has also had regard to the FOI Guidelines issued by the OAIC as required by section 93A of the FOI Act, as outlined above.
