Dear NSW Office of Environment and Heritage,

I am writing to request all communications referencing ‘Sirius’ building to and from ministers Robyn Parker, Rob Stokes and Mark Speakman from 2011 to August 2016.

As then-Minister for Environment and Heritage, Mr Speakman announced in August 2016 that Sirius building would not be heritage listed - against recommendations from the Heritage Council. Heritage listing could stop the building from being demolished.

As such, I am requesting his and his predecessors’ correspondence referencing ‘Sirius’ between 2011 and August 2016.

Good morning Ms Eddie,

It is unclear if you are requesting this information under an 'Informal' or 'Formal' GIPA Application.

Please complete the attached application form to proceed with a Formal GIPA application and enclose the application fee as stated (under Section 41(1) of the GIPA Act):

An application or other request for government information is not a valid access application unless it complies with the following requirements (the formal requirements) for access applications:
(a) it must be in writing sent to or lodged at an office of the agency concerned,
(b) it must clearly indicate that it is an access application made under this Act,
(c) it must be accompanied by a fee of $30,
(d) it must state a postal address in Australia as the address for correspondence in connection with the application,
(e) it must include such information as is reasonably necessary to enable the government information applied for to be identified.

For an 'Informal' request for information held by OEH, please advise if you wish to proceed and I will forward your request to the relevant business area, please note section 8 of the GIPA Act, Informal release of government information:

(1) An agency is authorised to release government information held by it to a person in response to an informal request by the person (that is, a request that is not an access application) unless there is an overriding public interest against disclosure of the information.
(2) An agency can release government information in response to an informal request subject to any reasonable conditions that the agency thinks fit to impose.
(3) An agency cannot be required to disclose government information pursuant to an informal request and cannot be required to consider an informal request for government information.
(4) An agency can decide by what means information is to be released in response to an informal request.
(5) An agency can facilitate public access to government information contained in a record by deleting matter from a copy of the record to be released in response to an informal request if inclusion of the matter would otherwise result in there being an overriding public interest against disclosure of the record.
(6) The functions of an agency under this section may only be exercised by or with the authority (given either generally or in a particular case) of the principal officer of the agency.
