Under s15(2)(aa) of the Freedom of Information Act 1982 (FOI Act), a request must state that it is an application for the purposes of the FOI Act.

As you have indicated that the agency should 'initially' process your request informally, your request will not be treated as a freedom of information request at all.

Please also note that pursuant to s15(2A)(c) of the Freedom of Information Act 1982 (FOI Act), if a freedom of information request is to be sent electronically, it must be sent to the electronic address specified by the relevant agency. The electronic email address specified by the Department of Health for receiving freedom of information requests is: [email address]. According to the Guidelines issued by the Australian Information Commissioner under s93Aof the FOI Act, the requirement in s15(2A)(c) will not be met ‘if the request is sent to an address or number other than a specified address (for example, the email address of an agency staff member)’ (at paragraph 3.48, last dot point). The email address you sent your email to is not the correct address for the receipt of freedom of information requests.

A departmental officer from the relevant area will respond to your ‘informal request’ in due course. If you are not be satisfied with the response to your informal request, it will be open to you to make a freedom of information request.

Whilst I disagree with most of your email, the request was made in error. It should have only been made to a ministers office and this was made to a council for some reason.
