Resubmitted Request for an Internal Review

Phillip Sweeney made this Freedom of Information request to Australian Prudential Regulation Authority

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Australian Prudential Regulation Authority.

Dear Australian Prudential Regulation Authority,

[Resubmitted]

Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Australian Prudential Regulation Authority's handling of my FOI request 'Regulatory Approval for the sale of MLC to IOOF - IOOF Approval'.

It is a matter of public interest that these documents are made available.
MLC's superannuation trustee, NULIS Nominees (Aust) Ltd was found by the Federal Court to have failed in its duty's as Trustee {Australian Securities and Investments Commission v MLC Nominees Pty Ltd & NULIS Nominees (Aust) Ltd [2020] FCA 1306}
On 20 September 2019, the Federal Court of Australia delivered its much-anticipated judgment in the highly publicised proceedings brought by APRA against IOOF's Chairman, Managing Director, three senior executives and two trustee entities for alleged breaches of the SIS Act. Jones Day acted for the former Chairman, Mr George Venardos.

Justice Jayne Jagot ordered that the entirety of APRA's application be dismissed and that APRA pay the respondents' legal costs.

The judgment was a resounding win by IOOF and the individual respondents.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/r...

Yours faithfully,

Phillip Sweeney
