Florian made this Freedom of Information request to Office of the Australian Information Commissioner

Office of the Australian Information Commissioner did not have the information requested.

From: Florian

Delivered

Dear Office of the Australian Information Commissioner,

This article, if accurate: https://www.theguardian.com/australia-ne...

suggests that the Office of the Australian Information Commissioner has been sitting on a complaint regarding the Department of Prime Minister and Cabinet’s non-compliance with the FOI Act for over 18 months now.

On 22 October 2019, the Information Commissioner was asked, at Senate Estimates, about her knowledge of that complaint and the Department of Prime Minister and Cabinet’s contraventions of the FOI Act.

Under the Freedom of Information Act 1982, I request a copy of any information contained in the background/briefing pack prepared for the Office of the Australian Information Commissioner’s session before Senate Estimates on 22 October 2019 that concerns:

- Any complaint received by the OAIC concerning the Department of Prime Minister and Cabinet’s compliance with the Freedom of Information Act
- Any investigation being undertaken by the OAIC in relation to the Department of Prime Minister and Cabinet’s compliance with the Freedom of Information Act

The information the subject of my request is in the public interest because it will be determinative as to whether the Information Commissioner has lied to Parliament in the commission of a criminal offence under the Parliamentary Privileges Act 1987.

Yours faithfully,

Florian
