Dear Fair Work Ombudsman (FWO),

The following is an application for the purposes of the FOI Act.

I am conducting research, across a range of Government agencies, into the Government's enterprise bargaining framework for the Commonwealth Public Service. Specifically, in the interests of equity and transparency, whether the Government's policy to reduce the living standards of rank and file public servants (that is, public servants who are not considered senior executive service staff ('SES')) also extends to SES public servants.

I refer the FWO to my FOI request made of the Office of the Australian Information Commissioner here (the 'OAIC request'): https://www.righttoknow.org.au/request/p...

By this application I make the same request of the FWO albeit such that every reference to 'OAIC' in the OAIC request should be read as a reference to 'FWO' for the purposes of this request. I rely on all my submissions contained in the OAIC request, in support of this request made of the FWO under s.15 of the FOI Act.

The purpose of this email is to confirm we have received your Freedom of Information Request (FOI) request on 1 December 2017 for;

‘Documents which detail the precise salary paid to each of the Fair Work Ombudsman’s (FWO’s) SES officers in the following financial years - FY2014/15, FY 2015/16 and FY2016/17’.

I note your request has been refined to only include to the salary paid to officers currently employed by the FWO (who at the time of the request are categorised as SES officers) and that you also consent to the deletion of any personal information other than;
• Information that discloses the officers precise salary for the relevant financial years; and
• Information identifying what the document is (e.g. a group certificate/payment summary, an employment contract or a s.23(1) Determination) and the period that it covers.

We received your request on 1 December 2017 and the 30-day statutory period for processing your request started from the day after that date. You should therefore expect a decision from us by 31 December 2017. The 30-day period may be extended by a further 30 days if we need to consult third parties or for other reasons. You will be notified in writing if we need to consult third parties and an extension is required.

The information released in response to your request may later be published online on our disclosure log, subject to certain exceptions. Dear FWO - FOI Requests,

Thank you for your email. I’m unsure of the basis upon which you have interpreted my request as permitting the redaction of the relevant SES officers’ names.

However, I am amenable to the FWO redacting the names of the SES officers concerned but only on the condition that each relevant SES officer's name be replaced by a single unique identifier such that each relevant SES officer's precise salary can be tracked over the three relevant financial years (eg. SES officer #1, SES officer #2, SES officer #3 etc). If the FWO is not willing to replace the SES officers' names with a single unique identifier for each relevant SES officer, then I revert to the terms of my original request (which requires the inclusion of the names of the relevant officers such that their salaries can be tracked over the relevant financial years).

For this reason, the processing period of your request has been extended by a period of 30 days (in accordance with s. 15(6) of the FOI Act.

As the scope of your FOI request was confirmed on 12 December 2017, the decision due date would be 11 January 2018. This date is extended to 12 February 2018 to enable us to consult with affected 3rd parties who may wish to object to the release of their personal information.

In response to your question, we received your request on 1 December 2017 and sought clarification from you. Your response on 12 December 2017 clarified the precise scope of your request. Therefore as per ss.15(5)(b) the decision due date would be 11 January 2018.
