Dear FOI officer,

FOI Request: FA 16/04/01254
File Number: ADF2016/16398

I refer to your charges notice dated 26 April 2016.

I seek your consideration to not impose charges for the reasons I outline below.

Firstly, it is unclear why it would take an employee of the department 1.22 hours to identify the relevant documents. Common sense suggests these documents ought to be readily at-hand for any departmental employee seeking such information. If a charge is to be imposed, I suggest a 10 minute search period would be acceptable.

Secondly, I am of the opinion it is in the public interest to see how public service agencies influence, or attempt to influence, the behaviour of employees outside the work place.

Yours sincerely,

James Smith

Good morning Mr Smith

I refer to your email of 2 May 2016, in which you have sought a review of the charges imposed in relation to FOI request FA 16/04/01254.

I note that the applicant in that particular request is Dwayne Brewski. Before the Department is able to consider a request for a review of charges that have been issued to Mr Brewski, the Department will require evidence that you have been instructed to act on behalf of Mr Brewski. Alternatively, Mr Brewski may wish to make submissions in relation to a review of charges on his own behalf.

Locutus Sum left an annotation ()

I can see from the other requests made by the applicant for "Social Media Policy" that almost every other agency says, "Yes. Here is the document you want. There is no charge." It is not so for the Department of Immigration and Border Protection.

In my opinion the response of the agency is a disgrace.

Dear Mr Brad Collins,

I have made the requested payment of $18.30 via EFT to the account as per your 26 April letter.

I note the FA reference you have given includes the forward slash character which was not allowed by my bank, so I have replaced "/" with ".".

Additionally, the account name you have given was too long for by bank to process so it has been truncated. If you do not receive the funds within the next few days, please contact me and I will follow up with my bank.

Finally, as Locutus Sum has pointed out in the comments on the 'Right to Know' page for this FOI request, I ask the DIBP reconsider how requests of this nature are handled in future. In particular, consider whether it would have been in the public interest to have released the requested information in the first instance. The correspondence resulting from my request to review charges, and the work involved in confirming payment, will clearly cost the department more than the funds I have now transferred.

I look forward to the reading the requested information.

Yours sincerely

James Smith
