Dear Mr Schroder

Thank you for your request below. Unfortunately we cannot accept it as valid at this time, because it is ambiguous in its wording and it . Would the following wording better reflect what you are looking for?

Potential amended request:

"The following documents, where they concern the request for the approval of the East Gippsland Shire Council Poplar Removal Program — Grey-headed Flying—fox (Pteropus poliocephalus) Summer Camp, Bairnsdale, Victoria (EPBC 2009/5017):

[Item 1] All correspondence sent from the East Gippsland Shire Council to the Department of the Environment and Energy.
[Item 2] All correspondence sent from the East Gippsland Shire Council to the Minister for the Environment and Energy.
[Item 3] Any supporting documentation provided by the Victorian Minister to the Department of the Environment and Energy.
[Item 4] All correspondence sent from the Department of Environment, Land, Water and Planning to the Department of the Environment and Energy.
[Item 5] All correspondence sent from the Department of the Environment and Energy to the East Gippsland Shire Council that specifically comment on conditions 3 and 4 of the approval for EPBC 2009/5017."

You will need to advise which "Victorian Minister" you are referring to for us to process Item 3 of your request.

Please note that the request appears to capture similar ground to your to your previous request, made on 27 July 2018. That request sought:

"I would like to request a copy of all reports, approval requests, letters, documents and management plans pertaining to East Gippsland Shire Council Poplar Removal Program - Grey-headed Flying-fox (Pteropus poliocephalus) Summer Camp, Bairnsdale, Victoria (EPBC 2009/5017) submitted to the Minister for Department of Environment and Energy, or any previous name of that department, from January 2009 to July 2018."

As you are aware, that request attracted a practical refusal reason due to its voluminous size, and this may occur with respect to your new request.

Pre-empting this outcome, you may wish to consider whether you are interested in "all correspondence", or if you are actually interested in a specific piece of correspondence or advice.

Feel free to contact me on (02) 6274 2721 if you'd like to discuss.

Dear FOI Contact Officer,
Alan Hilvert-Bruce
Senior Legal Officer| General Counsel Branch
Department of the Environment and Energy

Thank you for your suggestions. They are much appreciated. I will attempt to word it better and more clearly as your suggestions. But first may I take up some of your time in the spirit of FOI, if this is not imposing too much?

Does your helpful wording suggestion capture the essence of the following:

I would like copies of the documents [does documents also mean reports and in this case submissions to the then Minister Greg Burke MP, from the Victorian Minister of what was then the Department of Sustainability and Environment [DSE] do I need to mention them by name?] and supporting documentation from Bairnsdale regional office of the then DSE, now Department of Environment, Land, Water and Planning. Which were submitted requesting approval of the (EPBC 2009/5017) permit.

I have the approval document so that is not needed again.

Also:

The documents, reports and replies exchanged between the Minister of Environment and the East Gippsland Shire Council [EGSC], regarding the East Gippsland Shire Council Poplar Removal Program — Grey-headed Flying—fox (Pteropus poliocephalus) Summer Camp, Bairnsdale, Victoria (EPBC 2009/5017)

The documents/reports/permissions I seek are; as I obviously put badly in my request, regarding requests for reports conditions and works that are specified within the (EPBC 2009/5017) and any additional work outside the (EPBC 2009/5017) between the Minister for Environment and Energy and EGSC but mentioned within it like this:

[quote]

If the person taking the action wishes to carry out any activity otherwise than in accordance
with the management plans as specified in the conditions, the person taking the action must
submit to the Department for the Minister's written approval a revised version of that
management plan. The varied activity shall not commence until the Minister has approved
the varied management plan in writing. The Minister will not approve a varied management
plan unless the revised management plan would result in an equivalent or improved
environmental outcome over time. If the Minister approves the revised management plan,
that management plan must be implemented in place of the management plan originally
approved.

[end quote]

If you believe that the "All" is not required in my revised request items when I present what you suggested, I will be guided by your experience and knowledge.

Thank you, in case you are able and have the time to help me with drafting the revised request. It is much appreciated.

Yours sincerely,

Charlie Schroeder

Hi Charlie

As referred below, your request is likely to attract a practical refusal, as all documents we possess "concern the approval" of EPBC 2019/5017 - this is the Department's function with respect to the matter, assessing and maintaining the approval. It is effectively the same as your prior request.

Is there a specific aspect of the approval you are interested in? You are welcome to contact me on (02) 6274 2721.

Hi Charlie

Much thanks for the call this morning. As discussed this morning, I think you will be happy with the following scope, as it will give you good insight into the decision making process on EPBC 2009/5017:

[Item 1] The decision brief (including any attachments to that brief) for the approval on EPBC 2009/5017, signed on 11 April 2014.

[Item 2] The decision brief (including any attachments to that brief) for the subsequent variation to that approval, signed on 10 April 2015.

Could you please advise if you are happy to make a request with the above scope?

Dear Charlie

Freedom of Information Request no.180819

The Department of the Environment and Energy (the Department) acknowledges
receipt of your request under the Freedom of Information Act 1982 (FOI
Act) which seeks:

[Item 1] The decision brief (including any attachments to that brief) for
the approval on EPBC 2009/5017, signed on 11 April 2014.

[Item 2] The decision brief (including any attachments to that brief) for
the subsequent variation to that approval, signed on 10 April 2015.

The Department is required to process valid requests within 30 days after
the day a request was received. This 30 day processing period may be
extended under certain circumstances, for example, where the Department
decides it reasonable to consult with third parties. If the processing
period is extended, you will be informed of the extension and the reasons
for it.

The statutory deadline for providing a decision on this request is
currently 4 October 2018.

The Department makes two assumptions that affect the scope of the request.
These are set out below.

It is the usual practice of the Department:

·         not to disclose the personal information of junior officers or
the personal contact details of senior officers of the State or Federal
governments (including those of the Department). The names of senior
officers will generally be released. Your request will be processed on the
assumption that you do not intend to capture these details within its
scope.

·         not to release duplicates of any document captured within the
scope of the request. Further, where two documents fall within the scope
one differs from the other only with respect to minor editorial changes
(such as spelling or grammar corrections), only the later version of the
document will be treated as within scope.  Your request will be processed
on the assumption that you do not intend to capture duplicates or
documents that the Department considers duplicates (as per the above
explanation) within the scope of your request.

Please inform us if you do not agree to the request being processed by the
Department on the above assumptions.

Please note that information released under the FOI Act may later be
published online on our disclosure log.

We will contact you using the email you provided. Please advise if you
would prefer us to use an alternative means of contact.

If you have any questions, please contact the FOI team on (02) 6274 2098.
