Good Afternoon,

I refer to your request for documents under the Freedom of Information Act 1982 (FOI Act), dated , received by the Department of Environment, Land, Water and Planning (the department) on 11 November 2022, seeking access to:

The FOI Act provides that where a charge for access may exceed the amount
of $50.00 I am required to ascertain whether or not you wish to proceed
with your request and if so, inform you of the requirement to pay a
deposit.  

 

Preliminary investigations indicate that access charges will be payable
for your request. The estimate has been calculated as follows:

The FOI Act requires that I consult with the relevant third parties with
respect to personal affairs information (section 33 of the FOI Act),
commercial information (section 34(1) of the FOI Act) and information
provided in confidence (section 35 of the FOI Act) as their opinions will
be required to determine whether the documents sought are exempt.  

 

As the documents requested contain personal information and information
provided in confidence, in accordance with section 21 of the FOI Act, the
department has extended the period within which to notify you of its
decision by 15 calendar days from 30 January 2023 to 14 February 2023.  

 

With respect to personal information, under section 33(3) of the FOI Act,
if practicable, I must consult with the third parties who have personal
information contained in the documents. If I determine that it is
reasonable to release the personal information and the third party does
not agree to the information being released, I will need to provide
“reverse FOI rights” to the third party. This means that the agency cannot
release the documents to the applicant until a 60 day appeal period has
concluded.  

 

Can you please advise if you agree to allow us to remove personal affairs
information from the documents (such as names, titles and contact
information)? This would mean that we would not need to provide the above
appeal period and may speed up the process of providing you with
documents.

 

If you do agree to allow us to remove personal information from the
documents, I will only have to consult with relevant parties about the
commercial information in the documents.
