I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents relating to the topics of briefs for hearings
of Senate 2016-2017 Supplementary Budget Estimates. I have taken your
request to be for:

‘A topics list for briefs created in preparation for hearings of Senate
2016-2017 Supplementary Budget Estimates’.

If you disagree with this interpretation of your request, please let me
know as soon as possible.

We received your request on 15 November 2016 and the 30 day statutory
period for processing your request commenced from the day after that date.
You should therefore expect a decision from us by 16 December 2016. The
period of 30 days may be extended if we need to consult third parties or
for other reasons. We will advise you if this happens.

It is the usual practice of the department to not disclose the names and
contact details of junior officers of the department and other government
agencies, where that personal information is contained in documents within
the scope of a request.  The names and contact details of senior officers
will generally be disclosed.  We will take it that you agree to the
removal of junior officers’ personal information unless you advise that
you would like us to consider releasing that information as part of the
documents you have requested.

I refer to your request under the Freedom of Information Act 1982 (FOI
Act) for access to documents, specifically, topics list for briefs created
in preparation for hearings of Senate 2016-17 Supplementary Budget
Estimates.

 

I would like to request your consent to an extension of time to enable us
to complete processing your request. Under section 15AA of the FOI Act, I
am empowered to seek your written agreement for an extension of up to 30
days.

 

The reason I am seeking this extension is that the
Attorney‑General’s Department’s Supplementary Budget Estimates
hearing was deferred to a ‘spill over day’ which only took place on
Monday, 12 December 2016. As such, topics for the Estimates hearings have
only been able to be finalised very recently, and it is necessary for the
department to consider release of the topics list.  A one week extension
would allow the Department sufficient time to make a well-informed
decision on this request.

 

At present, the due date for completion of your request is Friday, 16
December 2016. Should you be amenable to a seven day extension your
request would fall due on Friday, 23 December 2016. Would you please
advise us in writing whether you agree to this extension.

Extension of time request under s15AB

 

On 15 December 2016, the Attorney-General’s Department (the Department)
requested further time to make a decision on your FOI request of 15
November 2016.

 

This request was on the basis that the processing period is insufficient
to deal adequately with your request, because it is complex or voluminous.

 

The Information Commissioner has decided to grant the Department an
extension of time to process your request to 23 December 2016. This
decision has been made under s15AB(2) of the Freedom of Information Act
1982 (Cth) (the FOI Act).

 

By granting further time it is anticipated that the Department will
provide a well-reasoned and better managed decision.
