Philip Nelson

Dear Australian Sports Anti-Doping Authority,

I am seeking a copy of the 2014 'Downes Review' being the independent review of the case against 34 current and former Essendon players undertaken by former Federal Court judge Garry Downes and commissioned by Sports Minister Peter Dutton.

I understand all investigations and proceedings against the 34 current and former Essendon players and support personnel have concluded, hence the release of this document will not prejudice or jeopardise any legal proceedings.

I understand this document may contain confidential material on players and/or support personnel. I acknowledge and accept such confidential material contained in this report which is deemed to breach a players or support personnel right to privacy will be redacted.

Yours faithfully,

Philip Nelson

The Memorandum of Understanding executed on 31 January 2014 between ASADA, Department of Health, and Hon. Gary Downes clearly states the ASADA CEO will make the results of the (Downes) report available to the Department of Health and Minister of Sport subject to any privacy and confidentiality requirements.

It is therefore assumed the report provided to the Department of Health and the Minister is a redacted report, and as such, should be readily available to be provided under this FOI request.
